I think you need to have a consultation with an immigration lawyer, if you want a legal opinion from someone other than your current lawyer. There isn't really enough information in your question to give an answer. Without knowing why the L-1A petition was denied, it's very hard to suggest a strategy. If there was an RFE issued before the denial, you should be able to see what CIS was concerned about.

In CIR 2007 (S.1348) Title V, subtitle B is skill act of 2007 SEC.524 says about people with masters and higher degrees will not be counted against the numerical caps. This says it is amending Section 201(b)(1) (8 U.S.C. 1151(b)(1)) which is about the numerical caps. As this is in the section of backlog reduction does this mean that those who already are in the process and is backlogged will be given green cards out the numerical cap?

I have an approved I-140 from an employer X. I-140 was approved 2 years ago. And last year I left X company and took a full time position. Since X is my frined he did not mind leaving his company at that time.
I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.
Now we got into some money issues and he wants to revoke my I-140/I485?
Can he do that?
Please advice.

Yes you need to renew her EAD every year or every two years now a days. You do not have to renew her H4 because now she is not on H4.

I am a question regarding h1b stamp.
I am working for a company (A) and I have visa stamp for company A until Dec 2010. I am planning to switch to company B soon. I was wondering if I need another visa stamp with company B or the same stamp will do. I am planning to visit India in February.

As for as my memory goes, you dont need to get a visa stamp till Dec 2010. However, when you reenter USA, you need to show the current company's I797 at the port of entry.

In one of the questionnaires, I am asked if my labor / 140 / 485 is pending. I don't know what to answer.

Does any of the forms for L1B renewal needs this info? Will it be an issue if I say no? Does USCIS really care?
-- if you lie and USCIS finds out then you are in big trouble. Also, existing applications can be looked up at any time (Eg: while adjudicating your 485 they can go over your old L1 application).

Hi all, apologies first off for not knowing all the technical USCIS lingo, but my question is relatively simple.
Situation: I am a US Citizen and I'm planning to marry a non-US Citizen in October. He is from India, currently on H1B, has the EAD, and is now patiently waiting. I don't know his priority date offhand, but I do know that he applied during all the crazy hubbub that happened in July-August 2007. (wow, it's been almost 2 years? time flies!)
Our marriage is totally legit, we've been for 5 years, living together, etc. What we need to know is, would it be better to forget the work-sponsored GC application and go for a family one? Or can he have applications for both at the same time? Would changing to a different type of application affect his ability to continue working at his current job, at all?

Greetings,
I have a pending 485 application under EB3 category through my wife's application. However, recently her employer applied for the EB3-EB2 change since she already qualifies for EB2. I understand that the priority date remains the same. In our case the priority date is Feb 05. I wanted to know what will be the process going forward. Currently the EB3-EB2 application is on the PERM labor state. Once that gets approved does it mean that our I485 will be adjudicated immediately since for EB2 the priority date has already gone past ours (feb 05)? Or we will need to then apply for another I-140?
If anyone knows the process of EB3 to EB2 transfer can he/she kindly post it?

You have to apply a new I-140 for the EB2 only then you can interfile with I-485.

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.
