anyone who is in the same boat - write on the forums - help each other and provide any nugget that could change the game...I do believe I got tremendous help from this forum and the morale support that was needed just to bear through each day. It helped me with my emotions and provided guidance and some comparisons.

In my view H1B problem is directly related to Retrogression problem. Lets step backwards and analyze this.
Why so many GC were applied at the first place that caused retrogression. Because a large number of people came on H1B to US. All these people who came to US on H1b did not actually had any extraordinary skills. These people somehow got in touch with these Desi Consulting companies and came here without any skill and without any projects. These desi consulting companies applied there GC irrespective of the fact that these guys have a job or not. Some of the people I know have sat on bench for years, living with their relatives, unable to get any job. But they had their labour filed. These knid of people would not have made to US, if these fadudent companies were not there.
Also big companies, have a policy not to apply GC before one year of service. The point was that these companys will file GC only if they feel that the employee adds value to the company. But with these desi companys people have filed GC even before joining the companys.
In essence if the GC process was working without these Desi companies, I can bet that the number of GC applied would have been much lower than what have we currently have.
Substituted labor has further added to this problem.
I cannot agree with you more. I have seen and met these fake consultants and their knowledge and skill level is zero. I can school most of these so called techies with 5-7 years of experience just with my couple of years of experience and a Masters degree.

Hardwork of immigrants is the bedrock of American society. If seen in that light it makes perfect sense. "We deserve," this thought also ties into the Pygmalion theory. That is the American way. This is not a collective but an individualistic society, unless you showcase your achievments they won't be fully acknowledged. Unless you show that you deserve nobody is going to give it to you.
On another note, I give my example, I changed my job last year and relocated. I don't work for a consultant either. My earlier priority date was Sept. 2002 but I was willing to make a move and not be held hostage to retrogression. I knew it would be tough and many of my friends on H1-B thought it was a bad decision. Atleast, now I won't regret not making a decision. This maybe an isolated example but my old employer hired two American workers to replace me. Maybe its because we work harder or maybe because its both, smarter and harder. Before I go any further, please read my disclaimer. The views are soley directed towards local market I am aware of and interests in i.e. GMADA ( Punjab/ Chandigarh area) and in no-way should my views/ opionion be applied to flats in Bombay/ Banglore or Hyd etc. With that said, hear me out.
Their is and last year I first hand expereienced massive infrastrucutral development going on in Delhi as well as in Chandigarh/ Punjab area. Their are supposed to be some Asian or Commonwealth games to happen in 2010. In addition to that, for some great reasons it appears the states closer to national capital had been lacking in basic infrastructural development. Can you believe Bombay-Pune highway is in better conditions than Ludhiana- Delhi, National Highway #1!. FYI: NH-1, is India's historically first highway criss-corssing the country from West to East. So they are playing the catchup game.
With improved basic infrastructure, living and commuting from satillite cities has become much easier than it was 10 yrs ago. Just like sub-urbs here, people want to enjoy life-style that is un-affordable in city centers. The NRI spending clout has wanned in recent years due to rapid development and growth in India. So the babus, politcians, industrialists, cops, Rich middle-class etc are coming in and taking away most of the RE. In addition to that, the basic infrastrucutral development funded by Government is giving a lot of monies to people whose farming land is being acquired to setup airport or industrial/ residentail sectors. These recently cash-rich farmers are not investing back in buying adjoining farm land but also investing in urban properties. You won't believe, but people were compensated quarter million per acre for recent Mohali/ Chd airport expansion. On top of all this, they ever growing population and shrinking available land is organically raising the prices.
With all that going, why would you think RE investment would fail? Plus remember the age-old adage "... Land never fails you." Jats do it!
Your theory that land values never fall in india is not true. Here is the proof. It is a question of affordability. Even if the population explodes and since most of them are poor, there is no justification for such high price appreciation we had in the last 5 years.

Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.

When I filed for my I-485 in 2000, the PD was current for me for 23 months in row when it got approved. Can you believe this? PD was current for whole 23 months while I-485 was pending.
One of my goals is to help my future legal immigrants. Being a US citizen gives me vote voice and power. I am open to suggestions. I would like to help my fellow legal immigrants.
I know, the wait time is long, but it is worth it every bit.

A lawsuit should bring things back on track. This is what happened in Jul 07. If it was not for the lawsuit dates would not have become current for Jul 07 filers. I feel there is pretty strong case here considering there are so many people who faced the same thing.

indian outsourcers have not intrerest in GC- why should they? After GC they lose their stranglehold on the employees...all they want is more H1Bs...
And on this issue too (h1B), they may actually end up hurting themselves, given the current climate in the US. Its too bad (and really unfair) that our issues are usually linked with the H1B issue...:(
