Hey man, whats wrong with the IT industry ?
Heck man he is from Stanford. He is EB2. How dare we lowly Eb3's challenge him. He can say what he wants. He is blessed with good fortune (read EB2) we are not. His suffering is not limited to GC. He is a tower of strength. In fact he reminds me of Atlas. Eb2 is one good thing in his others tough miserable life.
But misunderstand me not. He does not need your sympathy. He is a superior being, he is EB2. He should he admired and worshipped. Pray accept my homages. And if he says IT is a miserable industry just quietly nod your head and acknowledge and say "Master Eb2 what should I do discard this life of professional misery" and he shall deliver his wisdom.
And last but not the least be thankful to him. He has invested his stanford brain to offer us harsh but few paragraphs worth of wisdom on a Friday evening while the rest of us are out to drink or rejoice with family and friends. He choses to have none so he may offer us salvation. The sheer volume of his words astounds me. Thank you sir! I think you should sleep now, so you can wake up early and engage in a wise yet energetic discussion with us lowly Eb3 folks early in the morning who shall wait in earnest for you to vocalize your deep reflections on life and Eb2

Please post the name of your company. I would request IV to setup a webfax so that all of us can send webfaxes to such employers to stop this exploitation. The copy of the webfax should also be sent to DOL and USCIS (with the name of such companies) each time it is sent to the company. We should jam the fax machine of DOL, USCIS and such companies. If we do this to 5-10 employers, all others will behave.
Seems like a good idea but doesn't this make them even mad and jeopardize the chances of the employee even more ???

One of the important principals of trading longterm / day or swing is "DO NOT OVER THINK " Trader will loose all the rationale when his/her money is on the line.
DO NOT FALL IN LOVE WITH YOUR TRADES Get your profits and move out or cut your losses and move on.
MAKE A PLAN ...STICK TO IT
I will try to answer any questions that anyone may have. I can also give an overview of my trading strategy on my blog posts.

Look my friend, there is no logic like RD vs PD. If there were I would have had my green card before most here even filed their 485s. My 485 is pending for over 4 yrs now.
I have had people with PDs after me, RDs after me, all sorts approved and I am waiting.
This is a game of luck and chance.
The USCIS process is chaotic and disorganised in the way they do things. If you are lucky you get your approval earlier, if you are not, your application languishes in some salt mine in Utah or wherever else NSC stores their pending applications.
I think I saw this in one of the ombudsman's reports to congress. A certain percentage of files are misplaced/lost every year. I have a sinking feeling - mine could be one of these. If so, I will have to wait until someone at USCIS stumbles on it :-). I agree completely with you and there is really no way to predict how USCIS processes GC's. USCIS incompetence is boundless.

Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

I read that there are 2800 EB3-I visas a year, or about 233 visas per month. Assuming there are about 700 numbers available for the rest of the year 2010, using the data in the latest May-2010 I485 inventory, the calculation is pretty straight n easy with no spillover calculations involved ... here is a possible progress of the PD:
Sep-2010 : 10-Dec-2001
Sep-2011 : 31-May-2002
Sep-2012 : 15-Sep-2002
Sep-2013 : 01-Jan-2003
Sep-2014 : 01-Apr-2003
From there on the numbers are huge per month - about thousand pending 485 per month ... it'll continue at less than snail pace :D

USCIS proved my progress prediction as wrong ... Per Aug-10 visa bulletin, the dates already moved to 01-JAN-02 whereas I was guessing that by Sep-10 it'll move to 10-Dec-2001.
Guess they'll just move it forward just to attempt to use up all available numbers. Neverthless it's positive for many who have been waiting. But it just makes the future predictions tougher. Lets wait for Sep-10 visa bulletin and then do another round of predictions after the I485 inventory is released.

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help.
