Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

Hundreds of legal immigrants are resorting to a new tactic this week in their pursuit of green cards: sending flowers to the head of U.S. Citizenship and Immigration Services.
The publicity stunt follows lobbying efforts and lawsuits protesting a sudden change in the rules that govern employer-sponsored immigrants. After rushing to submit green-card applications by July 2, the immigrants were told at the last minute to keep waiting.
Notes being delivered to Emilio Gonzalez, head of USCIS, along with the bouquets skip over the pleasantries and speak directly to the bureaucracy.
"Kindly do not return our I-485 petitions in July," the messages say, "and honor the original DOS visa bulletin."
The dispute concerns a U.S. Department of State bulletin from mid-June, dictating who could apply for an immigrant visa. The application is the final hurdle in getting a green card, or permanent residency. Because of a backlog, immigrants spend years waiting their turn, but the unusual June bulletin gave most job-based immigrants the go-ahead to apply.
Jakub Gorecki, who lives in Spring Valley, hurried to get his paperwork together in time. The thick packet of documents - medical exams, vaccination records, a birth certificate from Poland, a $325 application fee - was to arrive July 2 at USCIS, he said.
But that morning, a new bulletin came out, canceling the offer. No applications would be accepted until the new fiscal year in October.
The reversal sent Gorecki and others back to a limbo state.

NO LUD after Feb 2009 when i did my second finger printing.
Created SR thru NCSC, did not help.
Went to Infopass, no help from ppl i spoke with there.
Did congress man enquiry, not sure if this helped. (as of yday, they had not received a response from uscis and were still waiting for a reply)
Sent letter to Ombudsman, they told me they were checking with USCIS...
No Idea which one worked... Good Luck to all of you...

So it looks like airline/airport personel know about AP and would not make a fuss for not having a valid unexpired visa in your passport if you carry your AP.
It's curious though why the guy wanted to see your EAD when EAD has nothing whatsoever to do with travelling.

I recently traveled to Chennai. My H1b visa was expired in my passport and have an approved AP. I traveled through AA (Frankfurt) --> Gulf Airways (Bahrain) --> Madras and ultimately to Tirupati by Car, While going to India no one cared to ask for any documents not even in Frankfurt. By the way if you don't know this, you don't need a TV for Germany if you have AP. While coming back (I just came 2 weeks back), the officer at the Immigration counter looked at my passport and asked me how can i travel to US with an expired US Visa. I didn't give him my AP with my passport coz I was lazy to take AP from my bag. Finally I showed him my AP and he let me in. Now all the officers in India know about AP. They wont be surprised looking at the AP. In Bahrain I had a lay over of about 13 hours. Gulf Air gave me hotel accommodation. At the Bahrain immigration counter, the officer flipped 2-3 pages in my passport and didn't even care to look at my visa/AP. In Frankfurt, while boarding the AA flight to Dallas, the lady at the AA counter verified all my documents even my office badge. If possible carry your office badge/ID card with you. If you don't have one it should be OK because you are not required to carry and you can always tell them that you are not carrying. Since I showed her my AP, she took all my documents including my badge to her supervisor for the approval and finally gave me the boarding pass. In DFW the immigration was like a piece of cake. I was the second person in the queue. CBP officer after taking my finger prints took me to an officer (Secondary Inspection). The officer at the Sec inspection verified all my documents in his system and asked me to show my EAD. After checking my EAD, he said its not mandatory to carry EAD but safe. The whole process took less than 15 minutes. Let me know if you have any other questions.

If EB2 row perm hits 10000 apps thats it pd wont move a bit. That will happen as soon as hiring starts again. This will happen any time, if this not happen until sep 2010, then EB2 has a chance. There are about 15000 (approx) EB2 Row apps siiting ducks in Perm centers, if ROW PErm eb2 approvals start flowing then we are just stuck. It all depends on EB2 Row Now. That is the one we need to watch closely.
Even if the economy improves, it will take some time to plan the recruitment, then hiring people and then they will take sometime to start the PERM process and then filing it and getting the approval. FOr all these things to happen, it will be a minimum of one year ad even it may cross two years. Don't bother too much about this.
I prefer the economy to improve over getting GC, if economy is good we will not have to worry about getting a Job if laid off and also, if we have EAD we can change jobs easily and many of the problems without the GC are not that siginificant then.

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

However as it was pointed out in another forum, Texas and Nebraska process only EB cases. In their cases, the rate of preadjudication is very high....over 90% in Texas. I cant fathom the Nebraska numbers.
The preadjudication numbers, in my opinion, are of the EB cases. The data, on the whole, needs to be explained by USCIS, better.

It is not clear what you mean when you say that. How can you get EAD without filing for 485 [which you can file only when your PD is current].

My current situation is that my wife and I applied for 485 separately.

I applied for 485 in Oct 2007, Since my PD is 2003 and is current as of now ( my 140 is pending ), I talked with our companys lawyer on what options do I have with regards to my wife's 485.
My lawyer suggested 2 options.
1. File 485 again for my wife as a spouse derivative. As per lawyer, this is very common and has experienced with these kind of situations.
2. Instead of filing a second 485 for my wife, just write a request letter to move her pending 485 to my 485 as a derivative. If this porting is successful, she cannot move back to her own 485.
I know some of us have gone with option#(1), but since option(2) involves very less paper work, did any of you have used this option so far?
I am confused as to which one to choose. My lawyer spelled diplomatic when asked about which option is better/safer:-)

Today I have frank and candid talk with senator office staff. This time I put FIFO question in forefornt (becoz I know what she will hear from USCIS). She promised to raise the issue with USCIS senior staff. She requested to give my concern in writing again. Let's see if she makes any difference.

It’s approx 90 days. I didn’t even receive the Receipt Notice from NSC. Please help me track the fate of my application.
2. USCIS follows standard practice of First In First Out (FIFO) process. USCIS website reports issuing Receipt Notice for I-485 application received on August 2007. Why August received application are getting Receipt Notice and subsequent benefits (EAD, AP, etc) at the expense of July 2nd filed application? NSC have to work first on receipting and subsequent process of July 2nd application before NSC start working on July 3rd to August 17th Application. It’s unfair to applicant like me. My I140 is approved and I am a July07 filer of 485. In July08 I moved to self-employment after consulting a good lawyer. Now my previous employer withdrawn I 140 and today I got 485 denial notice. I didnot filed AC21 as lawyer told it is optional.. :mad:
