Good talent also needs to make up its mind as to which company to stick to. The "future job" labor petition is so full of holes that its misused lot more than its used.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

Does the A# belong to primary applicant or it can be written in Spouse Application too ?
Should only be put in the primary applicants !485. The spouse will have one on their receipt notice. The fingerprint appointment will use this number as an identifier.

My piece of advice -
I see that a lot of people are not happy about L1 visa holders replacing them or their collegues because the sponsering company is either not following the law or found a loophole.
It is natural to get angry and frustrated. But I would suggest - not to be insensitive to those people as it is not their fault. Treat them well and good and help them understand what it is and why are you concerned.
Do a proper assessemt on what exactly the issue is and definitely help ourselves to make sure fraud is not being committed.

You missed my point entirely. The better thing for everybody is to decouple the namecheck from the green card so that the name check can go on for as long as the FBI desires while you get the green card which can be revoked if the name check fails. To get a large government agency to spin their wheels faster so that some foreigners benefit in a post 9/11 world is a lunatic and impractical way of thinking.
Will all due respects, I did not miss your point; I completely understand it. But the reality is that, GC is one step away from citizenship and all constitutional rights. Even with BG checks if wrong people enter, how worse it would be - even if it is just an "interim GC" - without full BG checks. No sane citizen of any country would buy that kind of argument for his or her country. Rather, if you say 'I would pay for you to do your job better', then

According to FBI, it is not a pathological procrastinator or diabolically negative to immigration like CIS. Their job is not to count the immigrants, rather to make sure right people come in. They are overwhelmed by the demand and limited by staff numbers. Help them to increase their efficiency by adding more numbers to their staff. Similar arguments went thru the Congress like a cakewalk when USCIS recommended increase in visa/immigration fees: "more fees, more revenue, more employees, more productivity". With CIS, i have no hope for any intrinsic improvement anytime soon even with more millions. But one can still have hopes on FBI.
With few 100,000 new applicants in the past 2 months, it would be a joke to ask FBI to skip the BG check and give them all GC. It is going to be more sadder joke on us, when this flood of new applicants start pulling down the name check process to oblivion. There are going to be more people among the new applicants stuck with BG checks in the next 2-4 years than ever had been.

i just called DOS. He asked for my visa type and passport number. He said "your visa has been issued in Jan. Call the New Delhi consulate and they should let you know if it would come through mail or do you need to go pick it up"
what happens next ?? how long after this stage it takes to get the visa ?? are there any other checks that could be going on ?? ONCE DOS approves are there any other agencies like FBI, KCC doing some other approvals as well ?? if you know what happens next let me know..waiting for posts..
so now i know I am not stuck due to PIMS and DOS cleared and approved my visa in Jan..what else then ??

I signed for the Vonage initially was their customer for about a month on world phone. However, Lingo's attractive feature of calling form my mobile to any phone in India lured me to switch over to Lingo. i requested for phone no portability and am expecting the device shortly. I remember initially on this forum it is being mentioned that Calling from a mobile attached to a lingo phone was free only to call landline numbers in India. Couple of days back when I enquired I was told that it is no more restricted to landline but is to landline and mobile phones in India.
Just want to reconfirm with members in the community if some one has concrete information about this feature. Once again the feature am talking about is Calling from your mobile through Lingo to any mobile or landline number.
May be those who are already lingo customers can chip in their thoughts.

Do we suppose to send I-130 with I-485 application? I have re-filed for my self and my wife for I-485 based on approved I-140 EB2 Employment. Please let me know.
My application filed on July 2 was rejected (NSC->CSS) saying missing I-140 I797 approval even though it was attached.

Yes you can work on EAD but join the employer after getting GC. He should support you if you get any RFC that he still intends to hire you.

With all we have to go through with the retrogressions and whatever comes with it, this is the last thing we need. AND...No, sorry to disappoint you but I am not in the country illegally and I don't intend to commit fraud... is that clear?????????

All these requirements are Position Specific. Before publishing externally, most companies (HR) decides the policy first for an example to which kind of person they will hire for this position like " We will not consider H1 for this position" seeing the "Critical and essential need of "blah " blah"..." And they then follow it. So it may happen that one person gets an answer " We do not consider EAD holder for this position.." and next month you may meet somebody (EAD Holder) working for that company on EAD but for different position as company made apolicy to hire EAD holder for that particular kind of position.

but that's legal because a job can benefit from the skills of a phd holder, while in our case of EAD vs GC or Citizenship the employer gets no benefit, it's just his arbitrary will, that what made it illeagal

I recently purchased Vonage. Had to call vonage customer service for installation. They gave very good service and I could connect all my phone and then called India too! Voice was excellent ( I have verizon DSL line).

NO Matter how many people say "Take it easy" its simply not possible, you will have to be a superhuman to do that. Sure its stressfull but no more stressful than boarding your first flight to USA. no more stressful than attending 1st H1B interview at the consulate or your first client interview. So in the end, we have been through all the hurdles with most of us surviving 2001-2002 job markets and now is 2007.
The point is we have been through all that successfully and thats a BIG WIN. So we will be through this too, but not without stress. The day we decided to come to USA and until now we have been successful as we are resourceful and can improvise at a short notice and we will. We are shrewd individuals and We Will PREVAIL.

His point is to keep documents ready in case you can replace the ones sent by your lawyer (paralegal really does that) whcih is often rife with errors.
Plus its easier to spot errors in your lawyer's work if you have correctly filled forms to compare them with.

yes, but july 2007 VB and the subsequent USCIS change related to approving cases with pending namechecks added a significant number awaiting for approval. Then a couple of months back USCIS woke up from slumber or had a shot of 100 proof single malt, re read some law and decided that the overflow allocation should be changed. The result is that there will be next to nothing for EB3 (for that matter EB2 will also have less overflow available) as they clear the backlogs, i doubt anything besides a recapture in the short term and a significant rehaul in the long term will work...i hope i am wrong but EB3 I and C are in for a long wait.

For last 10 years EB3 took numbers equally from EB2 and EB1. Even when EB2 was retrogressed EB2 numbers where made available to EB3.
