I came here on F1 and i was on F1 when we applied for 485.
after i got my masters i did not apply for opt and used the EAD card i got through 485 for working.
I changed my status from F1 to H4 once i graduated.I never traveled after i came here.
Will i face any problems in future when our pd becomes current.
Our lawyer says there should not be any problem but i don't know if he is correct.:(

Ok, I had hoped not to bite the bait, but I am human, nothing recharges and roils like someone saying "you are EB3, you are worthless compared to US the mighty EB2s".
The misleading continues
1) "VDLRAO" (no disrespect to his prediction capabilities) says EB2 will be current soon, so why are you raising this voice.
Well, if it is going to be current soon enough, then any action to redirect EB1 numbers should not be a cause of concern for EB2s should it? If you are going to become current soon, then it means there aren't many people waiting in the queue.
2) We should support the visa recapture
You all are assuming that EB3 does not support it. Unlike me, most EB3s are very active in calling, contributing and supporting those events. I have personal reservations about asking for a change in law when I am the direct beneficiary (I feel like those big oil companies who use their clout to get laws favourable to them, nothing wrong, just that I dont like to do it). Having said that, I have no problems in asking and demanding that the law be applied as written.
Once I have my GC done with, I intend to write to the representatives that barring progressive experience in the same company rule should be removed, because it is the experience that matters, not where you get it. Why should someone who chooses to be loyal be discriminated against another who has no qualms about his company's future.
3) You dont have the law on your side, USCIS/DOS only implements the law.
Some within EB2 concede that the law is fuzzy, while others claim there is no basis for our campaign here. Well, there was no basis for so many things that IV has accomplished, and yet, most people accept that we are better off in some ways compared to pre-IV. Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. A friend of mine forgot (!!) :confused: to renew his EAD when it expired last September. He then applied for renewal 60 days after the expiration date and got his new EAD without any problem, no questions asked!
I filed for my own renewal about 90 days before the expiration date and when about 85 days had passed and I was getting worried, I called USCIS and was told: " Do you need the card to show your employer that you are legal? No? Then, don't worry about it. As long as you applied on-time, you are fine." I actually received the EAD five days after the expiration date...
These two experiences are from California Center.

I recharged my account 10 days back at aitell 9.99 for 600 mins valid for 45 days. Today not allowing to make call due to insufficient balance. From the call history on their website, I only used 300+ minutes after recharge. I got doubt and looked all my recharges and usage from last 3 months. They are giving less minutes than advertisements on their website. I called to check with them today and customer service number is always busy. Any body using Airtel check your account history.

The competitive angle did occur to me. There is no reason a business should not look for ways to cut costs. However, this is a question of fairness & legitimacy. A L1 visa person living in a low cost country and coming here temporarily on short-term assignments can make do with lower wages because he likely does not have to support a family here at the US cost of living, and L1 spouses can work. This is not fair to a H1 with same skills whose H4 spouse cannot work, and for the same reasons it is not fair to USC/GC folks. Isn't that why we currently have all this labor certification processes and DOL laws? Those laws are designed to level the playing field. It is not easy for the company to outsource entirely, so they break the law by abusing the visa. Why should we not act to stop this illegitimate corporate action?
If that does not sound reasonable, let me ask you this: Why should USCIS and law-makers even consider taking steps to address green-card backlogs, adding resources to process more cases more quickly when they can just sit there and collect fees from you for visa / EAD renewals?

Why should US give us Green Cards? Why should they even extend H1 beyond 6 years?. If they do not extend H1, always new guys can keep coming on L1/H1 and the cost to employers will be much less. USCIS can have lots of money for H1 renewals. Only the body shoppers and end clients will benefit. Are you supporting more body shopping?
L1 dumping is VIOLATION. They can not work at client's place. When there is a competition, it should be on fair terms. If your pay is XXX K, other H1 or US Citizen/GC holder will compete with you for that salary plus minus 5-10 %. But these OUTSOURCE company's that dump L1 are competing for that job with 30-40 K. Can you guys believe this? Ask that guy from that BIG outsouce company, he will tell you, he is on H1. Take him for a drink, he will cry infront of you that he is paid peanuts and is on L1. He took this job as he wants to come to US and that his spouse can work. So he can afford to work for that peanut. Can H1 holder compete with these guys where our spouses can not work? Even Citizens and GC's can not compete due to cost of living being higher.
If you are on H1, at least you can not cheat on W2. But in L1, there is no minimum wage rule.

:) Well, I was on F-1 before that for 2.5 years, so it wasn't that quick either. But then again, I'm not complaining.

First off, interesting thought. I thought about this a lot. A lot of my friends are citizens now. Most of them came at the same time I did or even after I came. They were at the right place at right time and did not languish in SWA & BEC like I did and did not wait in 485 queue for years like I am now.
It may be difficult to sell the idea of 10 year presence , but I believe the following may be palatable :
Consider the 140 approval date or I485 filing date towards calculation of the 5 years of residency requirement instead of GC approval date. You are technically approved to be a resident when 140 is approved. You are ONLY WAITING to be status adjusted for lack of numbers.
having said that I have NO expectation that we can achieve this. Think about it, we can't get simple things about GC done and aim for Citizenship :)
reminds me a famous quote about , some one who can't climb to the roof aiming for moon. (I sound pessimistic, but I am damn deserved to be one :)

I have my visa appointment at Mumbai for H-1B stamping on January 10th 2008. Is dealy happening only at Chennai center or it is also happening at mumbai center.
I have my visa appointment at Mumbai for H-1B stamping on January 10th 2008. Is dealy happening only at Chennai center or it is also happening at mumbai center.
