I-94s are submitted at the airport when you leave the country. In many cases there are no I-94s coz they have been submitted and no one thought of making copies of them before travelling out of country. I am sure I dont have all the I-94s that I ever used. I submitted them at the airport when I went out and didnt make copies.
I think it must be ok if you dont have all of them. Can anyone advise if that's the case?
My lawyer only asked for copy of latest I94.
She may have copies of some of my I94s in my file from previous H1 filings , but I am sure she does not have all my I94 copies. I guess only the latest I94 is required.

If you loose your job anytime during the GC process and cannot find another job within 15 days you must leave the country. Since you are fired from the job you are least desired, you are an unproductive hole. This should be tied along with EB2/EB3 category determination so you realy value the right people.

No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.
If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.
If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

I agree with you on this, there is some truth to this that there could be delays when there are multiple filings. In fact this is the first time when USCIS has to deal with so many multiple filings, a very few lawyers have any direct experience with it. From USCIS Standard Operating Procedure, there is a mention of "second filing" (not duplicate filing) in the following places:
1. Procedural Overview (Page 4)
2. File Review (Page 46)
3. Interview Waiver Criteria (Page 185)

In (1) and (2) above it says second filing should be handled under the normal process. Although if different A# are assigned case goes to CRU (case resolution unit). But if A# assigned are same, you are more or less processed like a normal case. In the end processing time for multiple filing is very much up to the discretion of adjudicating officer. my lawyer is basically saying: if we get lucky then one gets approved and the other one can be withdrawn at that point; otherwise at some point USCIS is going to issue an RFE asking us to pick one of those two petitions and force us to withdraw one before they make a decision on the other. For now we are sitting tight, waiting to see what USCIS does.

Hi All-
Any ideas where can I get the latest specs for the individual photos (I485 filing purpose). I searched the web but couldn't find a USCIS document. I heard they no longer accept the 75 degree looking face.
Thanks in advance.
Shouldn't the photographer know about it? I get my passport size photos taken at costco. I think they make sure that photographs adhere to the standard.

Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because
1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.
so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.
stay healthy! that is more important than stressing yourself on issues which in the long term do not matter really. (You will get GC on or two rears later in the worst case scenario). cheer up folks:D:D:D

I am not getting anyone to answer the phone in chairman Conyers' office. I am not going to voice mail also. All that I am hearing from the other end is ring, ring and ring... endless.
