My wife got her H1b petition approved but not the change of status, that is she did not get the I94 along with the approval (she was outside the country at the time of approval). I know that she should be going out of the country and get the visa before she can start working. But After some research I found that there is another option, which is filing "amendment petition".
Has anyone done this before. If anyone has done this please share your experiences.
Does she has any H1 visa stamped in her passport?

Get a new BC made, and attach 2 affidatvits. I was able to get the new BC in 2 days. Though 'coz I was bon in a Hospital
---
I wasn't born in a Hospital so they won't have a record.
I just spoke to someone at http://www.yourmaninindia.com/ and they informed me that Delhi doesn't issue Non-availability of birth record certificate.
Any other options?

Thanks a lot, rsayed!!!
We need more members like rsayed!
Please pass the Add ONE member message to the new members too. that way, it will have greater impact.
Come on guys, now that we are back from our vacations, let's make the final push for the Dec 31st goal.
yes, the goal was to be a 10,000 member community by Dec-31st.
We have not achieved that. Lets shoot for becoming a 8000 member community by Jan 15th. I think smaller goals are more easily achievable.

as for logiclife...he has had "enough of flowery protests"...i'll leave the rest to your imagination ;)
I am actually very dissappointed with myself. In the post rally MC fluster, I had made a mental note to introduce Logiclife and then give him a flower. But I hear he strongly opposes measures such as this :)
I had also promised to get Macaca on the stage and write with colorful Sharpies on his forehead.
Its probably best I forgot both...

With this attitude and arrogance, I rarely think there would be motivation for anyone to do anything for IV.
I started discussion by asking , how can IV convince me that my donation is going to help, I got shot down by ARROGANT ******** and got all reds as if I care. I was planning on a charity/donation drive of my own to get some money for IV.
Know lot of consultants, who really dont know what to do with their miles with every one a executive airline status.
Already have 10+ people pledging Poker tournament from my poker group with their miles for Airlines and hotels. We are talking of a Million AA miles.
Indian restaurants(s) having a Immigration week where a dollar of each bill be given to IV.
I was even thinking of standing at Indian stores in Dallas to ask people to consider for IV cause, as long as I believed and hence was asking.
I was just getting started with so many ideas for my free time.
Good luck in what ever you do guys. Note that GC is not everything and note that I am still on extended H1, family on H1 and EAD never helped me. so assumption that EAD helped my life is baseless. All these hypocrites are long gone from IV once they get GC. All we get is response that Mr X or Y , even after getting GC, is working fro cause. How can I believe.
Any organization can be successful if there are questions answered and not shot down. Just working at DC doesnt make some one a strong contributor for IV.Work at grass root level is so imp. What I have noticed is any one who went to DC has become headstrong, egoist and arrogant as if they own IV.
Please read my initial post before commenting. I always said, I am for IV cause. just convince me so that I can convince some one
Gisa pita dialogue,...dont ask what IV has done,, ask yourself what you have done... COMMON
Here it is, I can write in BOLD and RED
Your argument doesnt make sense at all. All are lame excuses at best. If you want to see what people are doing, you need to start work with people, see and believe. We cannot give you the notarized copy of certificate. You cannot sit on the fence and ask people to convince. As I said earlier no one is getting paid for what we are doing and no one is doing any favor for others either.
Dont waste everyone's time with your useless arguments. If you really want to do something, start the campaign for whatever you believe and if its really worth people will follow you.

Hi,
I am on H1B visa. My parents due to medical condition cannot take care of themselves. Can I get them on H4 visa as dependent? I would like to keep them for 2-3 years in US and take care of them. Please let me know my options.
Thanks in advance.

By grace of Almighty, finally my Inbox received the email from USCIS that I was eagerly waiting for.
Just few minutes back, I received the Email from USCIS for myself, my wife and daughter saying "Current Status: Notice mailed welcoming the new permanent resident".
It's a long journey started in August 1997 with landing in Washington Dulles Airport. Got a chance to start the GC process by filing Labor in 2001. The labor approval didn't come until 2007.
In 2004 had to take a transfer to different company which caused me to start the Labor again in Nov 2004. Lost the valuable 3 years of PD date.
Finally the approval for 2nd labor came just right before 2007 July Fiasco. Luckily I had my attorney filed my application on July 2nd itself. And Rest you know the story.
All throughout I was on H1B, on permanent employment and never out of status. Never had any problem with Immigration process except for the GC delay. In any way it was an interesting journey, making new friends, had the chance to live in SFO, LA, New Jersey, Virginia and currently in Maryland.
Many thanks to IV and its members for providing the wonderful platform for sharing and collaborating for common cause.
I wish all the best to all those who are still in queue. Hang in there. Your turn will come.

No offense, but, I would continue or increase my contribution, not because someone else is doing so or not doing so, or not if I would I get a tax break or not, but just because of my sheer appreciation of the IV core group's amazing efforts.
I have not (in the recent past) seen such a group of dedicated, decent and diginified people working together in a selfless manner to achieve something not only for their own good but for the good of hundreds and thousands of their fellow "sometimes not so polite, not so patient" sufferers.
I see my contribution to IV something similar to a contribution to a church or a temple. You give, not so that you'll benefit out of it, but because at the end of the day it is money well spent for a good cause.
If you benefit out of the efforts possible by your contribution, that's a nice bonus.
I don't look at my contribution as "I pay $20 I should get $100 in return".
For me, it is not an investment, but a good expenditure for worthy cause.
I just don't understand why people who suffer so much from the whole waiting would not contribute. If one day, IV core members decide to close this organization and go on with their lives, I would like to know how those people who have not contributed feel.
The economic theory, "inferior purge the good" works here. Without sufficient "good" individual, we will eventually be out of this game! So to those who have not contributed yet, do you want to see the disorganization of IV? Do you want to become a group for which no one would speak up for you? Do you want to wait desperately and endlessly for your GCs? Do you want to continue to work like a slave and feel worried about travelling outside US?... If not, please contribute!!!

I am not sure if a letter is going to help. I was going to suggest an SR but in your earlier post you said that your SR didn't work either. But if you are going to send a letter then I would suggest sending it to NSC. Your lawyer would have the address.
I also know that sometimes people write to their congressman asking him to look in to the case but I am not sure if that's a good idea.
The HR Manager at my company wants to send a letter inquiring about the status of my 485 application. My PD is current as of April VB and my RD is within the published Processing time. My application is at NSC.
my question is: what address do they need to send the letter to?? or is there another way to do it??
Thanks

Just one point Slumdog -- You know, I have never seen anyone who rents, writing this kind of a story and justifying his decision. I wonder, why not? Why do YOU have to justify over here? Are you justifying to others or you are justifying to yourself?
You put too much stress on "quality of life". One can have a good quality of life in a small apartment.
I keep telling my wife that our apartment looks small only when she goes to department stores and shops like crazy. Our walk-in-closet is the nearest thing to a Black Hole. Mass density is so high in that area that pretty soon even light would not come out of it.
I strongly believe in "Simple Living, Hight Thinking". I can not say I implement it all the time, however, I try to keep it in my mind during my decision making process.
Slumdog, You have great writing skills.
I agree. My mother used to say "Simple Living, High Thinking".quality of life:means different for different people.

Im still waiting too. e-filed may 23rd. fp done on June 17th.
Expedite request denied, have an infopass appointment on August 14th. I will see what they will say
Getting too worried as my current ead is going to expire on Sep 19th.
Looking at the tracking it looks like TSC has started to work on all these pending cases. Hopefully our petitions get approved soon too
Will keep you posted
I have the very exact EAD expiry date. I think after 75 days you can open a SR and after 90 days we can try for interim EAD.. That's what I'm planning to do. Please keep me updated on your case and infopass appt

This is an extremely bad bill. With India dominating not only the H1 visa quota and EB green cards applications but also body shops and consulting companies; eliminating the per country quota would massively and unfairly flood America with workers from India
Many defenders of the bill used flawed socio-economic reasons to justify their *shameful and selfish agenda. Unused visa for ROW (Other countries) is NOT because there are not enough skilled workers from other countries but because the uscis/dhs use the quota to conservatively hence at the end of the visa year there are still many quotas left. ROW priority date has never been current for a very long time
Would you prefer to work with 7 immigrants from India and OR 2 from India, 1 from Germany, 1 from Zimbabwe, 1 from Argentina, 1 from Slovakia and 1 from Burma? The bill will not only hurt professional immigrants from other countries but also will hurt diversity, the core and sacred believe of American people

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.
I totally feel for you right now. A lot of people are celebrating the unexpected news, and those that have applied for labor possibly MUCH earlier are still stuck.
Let's hope that the BEC keep to their new revised deadline and the Visa Bulletins remain rosy for you

Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.
Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.
Looking back, labor certification was the problem for lot of EB3 folks even though they were current at I485 stage. There was so much backlog (5 years or more) in certain states. While certain states could get the labor approved in a couple of months. People with older PD than yours could get greencards before Sept 2005. Smart guys changed their jobs and went to states where labor was quick. There was lack of awareness and easy availability of information as we have on IV now. Even now fortunate folks are changing jobs and filing under EB2 to significantly shorten their wait times. The whole Green card wait is a career killer for many and that is sad.
Between 2001- 2005 nobody did anything about the labor backlogs. The community was only anonymously browsing forums. There was lack of initiative and courage among the community. All people could do was look upto attorney or HR to do a miracle for them. I wish those folks between 2001-2005 did something like forming IV then. After IV was formed in Dec 2005 we focused our attention on Labor department to clear backlogs. Remember Backlog elimination centers? Folks today are just very fortunate that they can get Labor approved in a few months. I do not see the same amount of pain and desperation in the new people as I have seen in old timers. Many new filers still think that if their labor could come in few months, I1140 could come in another few months, their I485 should be coming in the mail very soon. It is only when they lose job, or their employer revokes their I140, or face problems in the process they start worrying about Greenecard, read more about what backlogs are and want to play an active part in IV.
