The aim of this appeal is not to compare or compete with EB1, PhDs, US MS degree holders or discuss other exotic bills!
There are several hundred EB2 / EB3 folks who have continued to live here for several years (many have crossed 10 years). They are stuck in the infinitely long GC line, for no fault of theirs. It is natural that people who have stayed for long have grown up children (who are not US born) and who need to go to a good college for a good future.
It is almost impossible to pay international fees and it is neither fair no appropriate to break the back of genuine law abiding residents, despite the fact that they have lived for
8 / 10 years and have sincerely paid the taxes due to the government, just because they do not have a GC.
For the "sin" of being Indian/ Chinese born and for the "sin" of not being able to get the GC because the rules favour long term indentured labour, an entire upcoming yonger generation should not be allowed to suffer. This is unfair and discriminatory. If any one of us had been from a country other than India and China, we would have obtained out GCs in 3 / 4 years.
The idea is to have the cases of all genuine, hard working, EB2 / EB3 employees who have honestly lived here and are continuing to process the path ot GC legally, be considered from the human angle, more so from the point of view of the education of the children.
When it comes to illegals, people scream about human values, humanitarian considerations, education of their children, family ties etc etc. What about us, who have followed the rules "to the T" ????
Is following the rules, going through the approval complex web of approval processes, paying taxes and trying to lead sedate and simple lives a sin?
Are we not human beings? May be we are labelled "aliens" but we are certainly not from Mars!
So friends, let us be clear in where we stand and what we are pleading for.
Unless we have the conviction and clarity we cannot make any progess!

I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".

You are critizising H1B indians and their employer screwing the system which is not relevent to what we are talking here. If you feel so, then attack who ever spoiling the system and regulate those. Instead you are trying to justify your interperataion is right and what DOS is doing is right. I will be the happiest person if they ban labor subsitution and ban desi consulting companies or H1B dependent employer participating in GC sponsering. Then this mess might have not happened.

What made everyone shut up including me was what was written in november 2005 visa bulletin. It was there for everyone to see how it was going to be interpreted. Anothe law firm had reported chines usage year to date and it was concluded that they may fall short of the 11,000 visas (ie., 7% cap). With all this available; not one lawyer has decided to sue department of state or uscis over this. Why is that? Maybe what they are saying is correct and you are reading into it what you want to read into it.
Any time someone gets around to explaining the system; they are automatically branded anti-indian. Funny but everyone I know through immigration is Indian. Therefore, whenever someone brands me anti indian or even comes close to it; I get a very good chuckle out of it and so do the people who know me that frequent these boards and immigration.com
How the visas are being allocated actually is pretty relevant because it helps everyone to understand how it all works and comes together. I had been on the record that maybe people shouldn't get too worked up about this. The louder one becomes the more scrutiny starts happening. Once the scrutiny gets wratched up a few notches; are you ready to counter it.
What is this scrutiny that you may ask?
Newspaper in Maine did very thorough investigation of companies who sponsored labors through Maine. It was very hard hitting whcih asked for comments from Department of labor and USCIS. Both are investigating it. Essentially it said that companies rented out a cube and filed 60 labors and 100 h-1b's when their real offices were in other states that were taking a long time to get labors approved.
Backlog reduction centers are challenging companies to prove that their headquarters were where they said they were? They are questioning whether there is a permanent job. Companies are not responding and letting the labors go. Don't you think department of labor will start going into the approved labors and start scrutinizing them.
California service center denied many cases for two companies that I know of who had revenues of over $20 million. Reason for denial was that they are temp. agency and no permanent job. No permanent job; no I-140 approval. Companies have gotten a good dose of H-1b RFE's from california service center regarding this. Many have gotten the h-1b's denied because they can't even substantitate they have a job for the person. If they don't have a temp. job then how can they have a permanent job. Chennai consulate is giving very difficult time to staffing/consulates. It has gotten so bad that back in early december; consulates in india said if you are good in english you can go to ther consulaes in india. Guess what? Chennai it only takes two days to get an interview now because everyone refuses to go there. Just a matter of time before new delhi and mumbai catch up. if consulates are refusing visa stamping for temp. jobs what do you think will happen when they start ratcheting it up a notch to the permanent jobs.
Main reason they haven't gotten into the permanent jobs yet is because nurses which are really in demand also get greencards through staffing companies and are outsourced. Since, nurses are needed; uscis doesn't want to give a hard time to the staffing agencies; therefore, they don't want to be accused of double standards. We will see how this will change if at all as retrogression and increasing visas and studies are performed how people are getting greencards come to light.
btw; I have been on record that as long as country cap of 7% is maintained; it would have disasterous consequences for India/China to allow 485 filing without priority date. Since the 7% cap applies then that means someone who enters usa today from ROW and files an eb2 labor will get priority over you. Anyone can file a 485 as long as they have a labor, 140 and they are in non immigrant status. I know of three people through other forum who were from ROW; came on visitor visa found someone to file perm labor get approved in a couple of weeks and then go straight to 140/485. Since they can file 485 right away they get precedence over india/china. Anyone on visitor visa would be eligible. This would number in the millions. It would be quite possible that there would be never ending retrogression for India and China.

I think we should unite among ourselves rather than talking about all these circumstances. Yes I agree with Ganguteli... People got their labor subsituted because they had a oppurtunity and a provision that was legally correct. Instead of sitting and cribbing lets look in a direction which is going to unite all these streams into a big force.

Even one year after July 07 bulletin, the State Department is saying that USCIS is not estimating accurately. Where is the question of estimates, they should look at ACTUAL data.
And where is IV management? Yes, people should work with their state chapters.....but now is the time for the core IV group to wake up and take up the fight with the higher ups in the goverment. Show them how the State Department + USCIS is treating immigrants because of their lethargy and laziness.
I think state department has made a mistake by writing that USCIS can not estimate (in the latest bulletin) and we should take full advantage of it. Complain-Complain-Complain, make them look bad, and in this election year they may act on it...........
Please stop taking out the frustrations on IV. It is very easy to do. All you need to do is write a post. But doing some real action is the challenge.
We are all like you and in this together. We try to create action items and guide and try to lobby within our limited time, energy and means. Everything else is dependent on members. If members contribute funds we lobby hard. If members are not even willing to contribute $5, and we can only get less than 5K in more than 2 months, how can we accuse core? If members write letters to administration or USCIS, call lawmakers, meet lawmakers etc that directly helps everyone. Members need to involve their big employers and have them contact administration and local lawmakers. We all need to contact media and raise awareness. We all need to create publicity of this effort so that more people can join it and make it successful. We will help you all the way in this effort. Come and travel to DC with all your state chapter members and meet officials. Try taking part in conference calls, answer emails and calls from all kinds of members and non-members, media outreach and mundane official work of IV yourself during office hours and you will see how difficult it is to manage this for IV team.Take days off from your work spend your own money on travel and hotel and visit offices and talk to lawmakers in DC. We will help you with the meetings. IV core has been doing that and we get such brickbats through such posts.

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.
One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?

Historically for the last 300 odd years, the country has two broad sections, believing in almost diametrically opposite philosophies. Federalists and Democratic-Republicans. Federalists believed in a strong central government whereas the Republicans believe in more power to the people and believed in self-regulation. Over the years, the tone/tenor of these parties have changed but the core beliefs have remained the same. Liberal Vs Conservatism, Tax cuts Vs Spending, Giving benefits to the comman man Vs giving benefits to small busineses who in turn will help the common man.
Obama's future success lies in how much he can pull the democratic agenda of 'helping 95 % of people who are middle class', building educational infrastructure, taxing businesses while spending to help the 'common' man, reforming healthcare while keeping deficit within acceptable limits ($500 billion maybe perfectly acceptable). A certain section of the republican party (read Bush+Cheney and gang) caused the republicans to take huge losses and gave Obama the boost. Tomorrow it can be Reid+Pelosi+Clinton who can cause the downfall of the democrats by over-doing the 'welfare' agenda. Thus I called it cyclical.

If you post the link of the ebay auction in IV and promote it, the bidding price would be much higher than that for a regular Wii in ebay.

If you post the link of the ebay auction in IV and promote it, the bidding price would be much higher than that for a regular Wii in ebay.

You know what. I would like to donate something to IV this holiday season. I have a Wii gaming console that I bought earlier during the year but never actually got around to play it much :)

First of all, It is funny that the guy who knowingly broke the law want help of law when he is victim. Now all of us know why laws are made in first place and why everyone should follow it.
Secondly, Beating the dead horse again, Thunderbolt should go to cops and give evidence of child abuse asap.
In terms of risking the case of hiring illegal for a job by going to the cops in my mind is a non issue. Because, he is exposed to that risk with or without going to cops himself. What if Nanny gets caught working illegal in some other home and she gives all names she worked for including thunderbolt. He has done a mistake and he should hire best attorney to plead that case if it ever comes up either by him reporting child abuse or some other way.
