    I am seeing several people contacting Congressman and opening service requests. These guys seem to have become current just this month and they do not have any patience. It is crazy in my opinion. As pointed out earlier there is lot of herd mentality on the forums and if one person posts, everyone else does the same. Some people I have seen on the forum call customer service every day to get case status. I urge people to read and try to understand the process than blindly following what others are doing. Secondly as posted earlier, tracking is also useless and a waste of time. It will not help you get your green card any faster. Have some patience and follow the process. Starting a service request as soon as your date gets current, cannot help you.

    I am in a similar situation. My wife who is on H1B did not worked till date.

    Is it possible if she carries the vacation letter from the employer and go to India for H4 stamping? My wife do not have any paystubs.

    I have also contacted my attorney and waiting for his response. I am running out of time due to the GC priority dates being current. If the attorney does that while she is in the country, it would take around 4-6 months. By then, the priority dates might be retrograted.

    I believe you have a answer. Please respond.

    Lawyers manage to do it if you are within the "unofficial" no paystub permissible timelimit. Or They manage by getting vacation letter etc... Contact a good lawyer.

    There is an advantage to filing through CP when USCIS is slow to process applications. According to statistics this has been the case for last 10 years with USCIS.

    CP approvals are pretty fast and when you apply they do not wait till the dates to become current, NVC process the application to the point where the only thing it needs is a visa number.

    For example April 1st when an applicants PD is current NVC will request a visa number for the applicant and any derivative applicants around the 10th of April (this is stadard practice). Then typically in the next 60 days (May or June in this case) schedule the interview. You get the visa after successful interview.

    If you filed AOS, USCIS is supposed to pull your case and start working on it when PD become current. From what we hear they do not do this properly, they do not follow establised guildlines (FIFO). CP has a distinct advantage in this regard. Only thing is you do not get to have EAD/AP.

    There are just too many fond memories to share in one post... but I do want to specially thank leo2606 who drove 70 miles to pick up myself, venkygct, vsraja and punjabi at the Dulles airport and then took us out for breakfast, then to the rally venue, then for lunch, finally to a hotel room we had booked for a quick shower, basically... like a shadow he was with us wherever we wanted to go! And... whenever we thanked him (and gdhiren who co-ordinated pickups/dropoffs for many others like the 4 of us) these guys, instead of saying something like "You are welcome", would profusely thank us for flying in!

    Its people... like leo2606 and gdhiren.. and many others are the true strength of IV!

    I think it is a good idea to make the title more prominent, like red, big, bold font, hightlighted...

    As a matter of fact, I didn't notice it when I came here two days ago. I was thinking it was something for running the website in a long term. Only when I saw many people were talking in this thread did I know that there are some urgent and serious things going on.

    Hunger strike ?, i dont know my friend, sounds like a neat idea to get attention, but then what happens if its becomes an indefinite hunger strike, i mean i hope you do understand the consequences of that.
    I think we are at a stage where people are fed up with the process, but i hope good things happen to people who wait.

    Waiting is all we have been doing for so many years. I have been living separately from my wife for last 3 years. When I reached out to Pappu on IV, he refused to do anything for me. I am ready to come forward and talk to media but nobody is here to listen.

    I am seriously considering some media awakening event these days, it might be suicide or whatever it takes but this DOS stupidity has to stop. Its affecting so many people's life. I agree GC is not a right that we can demand from US government but they can't treat us like this after investing so many productive years for this Economy.

    I just renew my passport at Houston, TX. It takes about 3 weeks. After so many tries, I was able to speak with CSR and she told me that it will take 3 weeks (this is standard processing time). I have received my new passport along with the old last week.

    to put numbers to your guess, I am guessing roughly even at an optimistic approach, 1000 applications from EB3-I from 2002 may have ported to eb2 or left the country and nothing more than. Why not we do these guys. just a IV sampling poll. Lets create a poll for IV members alone, for eb3-I alone. Lets give all the 12 months as option, and people can update. We can atleast know how many cases are waiting in eb3-I from IV alone for the year 2002. What say you guys? any one wants to take up the initiative? We can also Add an option additionally for 2003 cases and so forth as one option. Our goal is to find how many of us here in IV are waiting with 2002 PD for eb3-I.

    Why did they waste 500 EB3I last year. What makes them approve EB3 at that slow rate. All the cases are at NSC for 10 years. Why the ##&( they are issuing 1 year EAD for EB3I. There is no FIFA or whatever it is. How can TSC approve all cases at such a fast rate and NSC sits on them till the processing time is crossed and wait for a SR .

    Anyone has update on AILA's class action regarding audit delay cases?

    internet, I also agree with your opinion. What I am concerned is not affecting my case by DOL but any blames from my HR if they come to know. This might be my own problem and I will get over it.

    I will write the letter with or without case number.

Since morning at least 10 people who i have talked to from Tri-State area asked me if I know where is chanduv23? they just wanted to see the great motivator like you. Please point me to the picture where I can find you. Your posts on the IV forum have been an inspiration for lot of folks. It takes people like you to form a group of wonderful hardworking folks.

    Guys, Please do not ridicule saralayar. he has raised a very valid point. We are so involved with the GC issue that we are not able to think beyond that. I do agree with the fact that IV is so preoccupoed with GC crisis that there is no point (or bandwidth) to raise citizenship issue. I have seen so many of my friends who came with me in US 8 years ago and are citizens by now but I am still struggling with GC with no hope in site. Sometime, I think, by the time, I will get GC (if I), they will become sr citizen :) it feels very bad but cant help it.

    Somebody was asking that the retirement age be lowered. Gosh! and retire immediately on becoming a citizen?

    I can't tell you how p***d I was when I read someone suggesting ppl to "enjoy the moment". For someone who has been waiting 3-4 years for labor to clear and sees ppl getting in front of the line to get the EAD/AP, its just insane. And to tell that person to be not a "spoilsport" is just rubbing salt in their wounds!

    To my friends who are still stuck in PBEC, please have faith. You will hopefully be able to file 485 even after Sept when the dates retrogress again. My gut feeling is that dates will retrogress back to 2004 again. 2005 is when PERM started and that's where the bulk of applicants will come from right now. PERM filers will get the advantage of AC21 that you didn't have for all these years but plight of ppl stuck in BEC's has never been on anyone's agenda. So not much you can do.


    Totally agree! I was appalled by some peoples suggestion to those still stuck in BEC to "enjoy the moment" on behalf of others and "not to be a spoilsport". It is really very unfair, but you know what, like arihant says, it'll be like, "See you at IV in September" (when the October VB comes out) to continue.

    Only difference is, you'd have "filed" 485 and if lucky you'd have gotten a receipt, because you might as well kiss your AP & EAD goodbye because there is no way they can process this ton load of apps any time soon.

    I hope USCIS finally sees the injustice that has be meted out to the all the folks - whether in BEC or not - and process the application in a FIFO basis.

    I like this plan of mine better than the runners world plan. Please see below if you are looking to run. This plan is tailored for a beginner.A friend of mine shared this with me like 6 years ago. She actually calls this plan a Couch to 5K plan :D. This plan recommends you run 3 times a week. so choose your 3 days with a day of rest in between.

    Week1 - Walk 4 mins, run 1 minute ( repeat this 6 times = 30 mins)
    Week2 - Walk 3 mins, run 2 mins (repeat this 6 times = 30 mins)
    Week 3 - Walk 2 mins, run 3 mins(repeat this 6 times = 30 mins)
    Week 4 - Walk 1 min, run 4 mins(repeat this 6 times = 30 mins)
    Week 5 - Walk 1 min, run 6 mins (repeat this 6 times = 42 mins)
    Week 6 - Walk 1 min, run 8 mins (repeat this 5 times = 45 mins)
    Week 7 - Walk 1 min, run 9 mins ( repeat this 5 times = 50 mins)
    Week 8 - Walk 1 min, run 9 mins (repeat this 4 times = 40 mins)

    you are well onto your first 5 K in 8 weeks. The key is to focus on getting the distance first and not focus on the speed. The most important thing to remember is to listen to your body and respect it's limits.
