    Why are you equating quality of life to owning a house?
    - Because you are an "owner"? No you are not! You are renting the house from the bank
    - Because you have a backyard?- go out and rent a house. They are a dime a dozen, will cost you half the cost of your monthly mortgage payment
    - Because you have peace of mind? Really. Read your other post on people getting laid off
    - Because your (ok someone else's) kid asked if you are poor? Really? A kid's innocent question is going to make you gamble (that's what investing in an immovable asset is in your situation) away a decade of savings?
    - Because you want to give your child the best possible childhood? Think about it, if things turn for the worse either in your economy/company/job (absolutely do not wish it on anyone), and you are forced to move/sell the house/get foreclosed upon etc., how much more have you hurt your family and traumatized them in your effort to give them a great childhood?
    - How many nights of peaceful sleep have you lost lying awake wondering what you would do if you/your spouse lost a job, had to move etc.?

    I still cannot understand how/why someone would buy a house in the bay area ($700K+ for a SFH in a minimally liveable area) and $1M+ in places like Cupertino.

    I will enjoy my quality of life in my rented condo (with a rent 1/3rd of the monthly mortgage payment it would take to buy it) and take my 2 year old to the park if he feels like he needs a back yard. Dont need to mow the lawn either!

    Folks, any updates on anyone's case.

    No "Good News" from the USCIS - It's been 33 days, and counting...

    What's the average time it's taking these days? I've paper-filed through my Lawyer, though.

    Also, what's surprising is that my AP got approved in 3 weeks flat - and I also got copies of the same. But, no EAD yet - both for myself and my wife.

    Keeping my fingers crossed!

    This is the only escape route they have.
    Nothing else would calm down all potential lawsuits.

    I would be very surprised if they start working on cases submitted in July even if current and they get extra visa numbers. There are people like me who had submitted thier I-485s (with I-140) under EB2 back in August 2006 and were current back then. I'm still waiting.

    E-filed May 22 ,no updates
    Complete FP ,but no updates.

    gc_kavaali and gc_dega_gandhigiri,you say you received your EADs, how many days from EAD e-filing , did you get your approval email and how long from approval email to phusical card arrival .

    Please provide this information so that I know if I can wait patiently.

    I thought visa numbers are available equally per quarter and DOS is prevented from releasing numbers early. How can they say that all the visa numbers have been used (or will be used by April end)?

    Q1: Oct-Dec
    Q2: Jan-Mar
    Q3: Apr-Jun
    Q4: Jul-Sep

    I think July visa bulletin would bring some good news when numbers for the last quarter along with the spill-over (if any), are released. If USICS is not as efficient we may even see some good advancement. Don't loose hope guys!!

    It is explicitly mentioned that quota is over for "year".

    wow that's a long wait to file your labor. Well in any event you got your GC and i wish you could have gotten it sooner since IMO you should have filed your labor much sooner. Good luck in all that you have planned on doing.

    I see that most of you who are getting approved are 2007 filers. Any 2008 filers got approved?

    Also what is the number to call to Open a SR? Is it to soon to call since my PD is current only since yesterday. Folks who called to open a SR please let us know.

    �Update on Rejection of June �Other Worker� Adjustment Applications and What This Means for July�.

    I am manily concerned as USICS rejected the 485 petitions for "Other Worker s" last june ,they can also do the same now if they received huge number of applications ( 40K) in the first few days .

    After a little bit of delay and suspense and a number of Soft LUDs...I finally received my renewal EAD today. Hurray !!! It almost feels like receiving a GC.

    So, here's the deal:
    E-filed for myself and my wife on 03/16
    Approved on 04/09
    Wife's EAD received on 04/12
    Then started all the drama..
    A lot of LUDs..but no card for me. The status shows approved ...one day and then Post-processing and then again back to Card-production ordered...Here and there and last week i saw a message saying .."Your new card is sent to your address on file". I must've checked my application at least 10 times before submitting...No issues with the application. But hey...All is well that ends well.

    All the best to everyone else too...Always be hopeful and celebrate every good news..

    It is difficult for me to produce all "Proofs" at this point of time, perhaps if I dig my some of past CDs I may be able to bring some articles but it will be a hell of time. Anyway still trying to put some explanation. First of all you need to understand the difference between today's bulletin system and bulletin system prevalent around 1999-2003. I vaguely remember, mostly till 2002 mid only Mexico and Philipines and India were "oversubscribed" countries.INS played a very smart game with bulletins then as well but somehow there was no public cry like what we experienced during this july. I do not remember exactly but probably during almost whole 2003 and perhaps for some months during 2002 India was out from "Oversubscribed" category. Before that India was used to be "Current" almost all the time. Now during the time India compeltely disapperared from bulletins, we needed to solely depend upon the internal news about retrogression and most of the information I was used to get from immigration.com and murthy.com articles and many articles were talking about this EB2 and Eb3 retrogression.

    Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.

    1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
    2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the �Other Worker� Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
    3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.

    Now let�s go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.

    To be honest with all of you, I was really disappointed in the message from AILA. In the rush to �inform,� they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.

    I got the "card production ordered" email today which probably means that the gc application has been approved.

    Here's the info for immigration voice team/users' tracking approvals

    my PD is nov 2005.
    Receipt date: 7/31/2007
    center: nebraska

    I got married last year and the lawyers were about to file the follow-to-join application for my wife in the next couple of days. But my application seems to have got approved first. Has anyone been in this situation before?

    I think you can still file the follow-to-join application after you get your greencard. You can do it only in the first 180 days after the approval.

    Second question is, In my old passport there are 2 valid US visas, 10 Yr B1 and 3 yr H1. How do I get them on to new passport?

    You don't have to ( you cannot) transfer visas to the new passport. You will have to carry both old and new passport together all the time. POE officers/Indian immigration officers will use the old passport to get all your visa and travel information.

    My interest in the house would be long term investment rather than quality of life.

    I beg to differ. House is a BAD investment. Historically houses appreciate approximately at the rate of inflation+1 or 2 % points.(Forget bubble years). Plus the costs(maintenance and property taxes) related to house ownership makes it a really BAD investment. Imagine putting money in an account which gives 2% returns and has 2% maintenance charges!

    House is a great place to live in. That is what should be in mind while buying a house.


    Another point is that most people are unwilling to spend lot of money on rents to get the same QOL. There is emotional element there called (eventual) 'ownership' but that's only emotional. That I don't care about too much.

    I agree. However if somebody thinks living in a bigger place brings a better quality of life, even then he/she does not need to buy at 3 times the cost of renting the same place. He can RENT. By buying you are bringing the quality of life down. At one time a place in my area which could be rent for appx 2000 dollars a month would take about 4000+ dollars to own with 30 year fixed. Reason? because rents reflect the buying power of the resident. Nobody gets a ARM for paying the rent!

    If the trend indicates prices are falling this year, I guess people will wait for a year more but at some point people will go ahead, depending on the overall economy start buying because no one can really predict the bottom. At that point, it may even start going up allowing the economy to slowly get back on its feet.

    Yes. I am convinced that if you wait another year or so, ratio of cost of ownership and cost of renting will come to some sane levels and that is when people should think of buying. I am planning the same.

    your lawyer is right. When you file 485, your employer should give a employment offer letter that states that you have a job offer as per the terms and conditions of labor certification. That includes the geographical location of the job offer.

    people who have excuses have excuses. We all do.

    There might not be lot of ladies on the forums but the ladies we have in IV accomplish a lot and are very dedicated. I will take a highly productive and dedicated team even if it is small. Cheers

    I have been swimming and strength training for quite some time now and have started kettle bells and Taek Won Do this year. I do see a lot of women working out. All I am saying is that these forums have a lower proportion of females.......pure statistics.
    And yes; there are a lot of females working out and the ones who do take up martial arts are more serious than the guys. However the most common excuse cited by the ones who hesitate to take up running/walking, is security. I am trying to get the ones who are not working out to get out; the ones who are; have a lot of tenacity.

    .............BTW, be nice to me. By the time you come to DC to run the race, I might have my brown belt :)

    [U].... The delay in approving an I-485 petition is not subject to the the July 2007 Visa Bulletin alone, it cannot also escape '[B]protectionism-tainted' FBI name check delay.

    Most of the male applicants from India gets profiled by FBI. namecheck hit may be partly bull ....
