    47K + 5500*2.1 ~ 58000 visas...for EB2 I to make it current. coldcloud-> you cut short the waiting time by half ( from 10 years to 5 years? :))
    I believe you dont need to multiply all of the 485 by 2.1 as already applied I485 will include the family?

    Guys,

    Can we atleast do a flower campaign than discuss over and over the same points. I see this is the only EB3-India thread thats going over 5 pages of late. I have sent 6 letters to the dept, Ms. Joe,John, USCIS etc.. and today I am sendning 6 more cards with some message to help EB3.
    I also contributed $100.00 and IV should get it tomorrow or Saturday.
    Please send card, messages emails, whatever to make EB3 also to catch up with EB2.

    Please do something before its too late. I am very hopeful something good must happen in Oct.
    We need more push from Core IV.

    I am not on L1, neither do I work in the kind of an assignment which will come under the radar due to this - but have many friends on L1. Hence I think I may have a slightly more balanced and perhaps somewhat sobering POV on this.

    Since I have many friends on L1 - I know pretty well how they are abused by their employers. Just the fact that you cant quit the employer enables some forms of abuse so subtle that they will not stand in any court of law. So I hope for the sake of people on L1, and to uphold the rule of law - that this abuse stops. If it does - their employers would be forced to bring them in H1 - which is far less prone to abuse due to the portability.

    However, the current "run to the DOL/ICE" approach that you guys are taking may have repurcussions well beyond you had bargained for. Think of it from the POV of a client manager (lets take the example of, say, a goldman manager). He has his hands full of sucking up to his boss, playing the internal politics and in his spare time doing some work. 99% of them (even those who actually immigrated themselves) have no appetite to get into the details of immigration law. So, as soon as there is a backlash on this - their immediate response would be to take the safest route out and require Citizenship/GC for all positions.

    As soon as that wave starts - many of us are going to get burnt. Many of us who have EAD, including yours truely, would probably be able to sneak through without too much of an issue (since it is illegal to discriminate against EADs) - however, many others who are not so fortunate would probably not fare so well. Most probably what will happen is that as soon as a recruiter sees brown skin and hears some trace of an accent - alerm bells would go off in the mind to check if this guy is GC holder or a citizen.

    The enabler of the L1 abuse is the non-portability of these visas. We cant do much about that in the current environment. But going all gung ho in terms of enforcement right now -when there is a recession in full swing - may not be in the best interest of any of us.


    The issue is that a lot of people on L1 come to US with an intent to *immigrate* permanantly and are not aware of the complexity inthe law. They think that they can wait it out by staying with their employer till the GC comes and thus are subject to exploitation.

    So many people on l1 actually look for h1b jobs and move on towards working towards their citizenship.

    While everyone want to immigrate to the US - which is the case with everyone - one also has to understand the law and work through the law - it is hard - but believe me folks - it is rewarding too.

    Sorry to hear that. Hope that will not effect your I-485 application processing.

    For me, I have not seen any status change to my 140. After a series of LUDs to both 485 and 140 at last today I see my 485 status has changed. It says RFE sent. Good that I have not received any NOID or Denial. This is the best case scenario that I was hoping for. I have yet to receive the RFE to see the actual cause. But hoping this is due to 140 withdrawal. I thank the IO who is working on my case as he/she is quite knowledgeable and issued a RFE not NOID or denial.

    So people please keep sending letters.

    On November 5, 2008, we mailed a notice acknowledging withdrawal of this application or petition I140 IMMIGRANT PETITION FOR ALIEN WORKER. If at some point in the future you wish to pursue the benefits provided by this application or petition, you must file a new application along with all applicable fees and evidence.

    I am not sure if this means that my 485 will be denied shortly...

    Why do we care about this red/green dot nonsense? Does it really affect anything in the real world?

    We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.

    Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.

    I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.

    I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.

    Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.

    I think this bill will not be passed if it is against WTO trade regulations.

    So you never know all these violation when you were in H1. What were you doing then. Why didnt you oppose then. If you know the violation did you call the USCIS and DOL and complain...No. Because you would end up in trouble. Now you got your GC and no matter if other guys are end up in trouble, in fact it would be helpful for you... Are you ready to review your status thorught all your H1, all your PREM processing to prove there is no violation...? Eveyone know how things are working. So if you got your GC just keep quite and move on. When you can not be helpful to others...why you are just creating pain.

    If you are worrying about the wages..let them free the employees from employer. Thats the best way to clean up the system. If you are really pro-immigrant your thoughts should align in that direction. But most of us see you as Ron Diamond in the making. Its very unfortunate. One study shows that only immigrants opposing immigration more than natvie people.

    It looks like USCIS is interpreting the rule the way they like.

    It looks to me that they have lots of pressure from big companies and they are approving their applications in Particular. e.g., EB2-I with PD of 2006 are getting approvals, however EB2-I with PD in 2004 are still waiting.

    There is no FIFO here and there is no clear rule. They can do whatever they like.

    I am EB3-I too, plz don't take me wrong.

    Maybe FOIA request by IV was one of the main causes for this data to be posted on the USCIS website. USCIS thought that since the cat is out of the bag anyways, why not make the data public as part of the redesign effort of the USCIS website.

    If the data provided to IV on the Donor forum matches with that of the USCIS site, there might be some other details in the IV report that can give us a better picture.

    No, you can still get your EAD while your I-140 is pending as long as your PD is current and you can file for 485. But I would not change jobs with AC21 till the I-140 is approved, if I were you.

    If you already have applied in EB2 you won't be affected.
    If you have a Masters you won't be affected.

    I have a small doubt here. I'm still trying to understand this porting business. Why is that those who have already applied in EB2/Masters will not be affected?

    If people with earlier PD port to EB2, it will make my processing longer, no? (IFF my PD is later than theirs')

    I'm not for or against this action of yours, but just curious about your assertion. Please let me know.

    Letters sent. Is there any update from IV on getting this out to Media, Greg Siskind , Zoe Lofgren etc.? Or maybe we should wait till Feb 9th and see. Also, I am seeing many frustrated ppl on also since Feb bulletin. Encouraging them to come together with IV campaign.

    My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

    I would like to give update on visa availability. My PD is 03/06- EB2. Opened SR for me and my spouse on 08/30/10

    1. For me, letter by USPS came stating that, I485 is at USCIS local office and will notify about decision in 30 days

    2. Spouse got below response by email (On 09/13/2010)

    "The status of this service request is:

    Your I-485 application is waiting for a visa number to become available. When it becomes available, it will be assigned to an adjudicator to make a decision on the case.

    If you have not heard from the service within 30 days after your number becomes available, you can make an Info pass appointment to visit the Customer Service Division,
    at the District office"

    On 09/14/10 we took infopass and spoke to customer service representative. She told that visa Numbers are not available any more and also checked validity of finger prints in system.

    Told us that they are expired (Till now we gave 2 times, one in sept 07, 2nd one in may 09 (FP are valid for for 15m)) - I guess we need to give 3 rd time soon.

    She told that dates for FP at ASC center are not available and will try to send us ASAP when Visa Numbers are available.

    Did you check if you are under EB2 or EB3 with USCIS?

    Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.

    Yes, lets write to Secretary Napolitino. I will also send a copy of the letter to the first lady. I am not sure what else we can do besides that.

    Once I get the sequence to call TSC using the POJ method, I will try calling them tomorrow.

    I am july 3rd filer, still waiting for receipt. In your e-mail you said there was LUD on your I-140 date 07/28. What it means...did you file I-140 and I-485 together? is there any connection in getting receipt of I-485 and LUD on I-140, just curious becasue I am also seeing LUD of 07/28 on my I-140 but my I-140 got approved in 2006.

    I am also july 3rd filer with I-140 LUD of 7/28. What i believe they touched our application on that day.My 140 also approved on 2006.

    What if the USCIS suddenly realized that they can make more money in August due to the fee change? So someone in dept had a brainwave thinking - why not move back the dates in July and move forward again for the August bulletin??
