    My PERM app was denied in Nov 2006 and my lawyer filed a Request for Review. have not heard anything since then.

    Does anyone know of such cases where a PERM app has been denied and how long does it take to get a decision on Request For review. Please PM me

    The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps.     Well I had called a NY congresswoman when I was stuck in a H1 name check. I found them open and willing to help. She even contacted the FBI.

    Well I am just an ordinary person, and the same as everyone here, and not saying I will do everything myself. There are persons who are better skilled at this and know the immigration law better.

    Also don't rule out lobbying, I just said we also need something else that should justify our case without a lobby. I'm asking for suggestions or ideas.
    I may be new here, If you see my post on the other forum, I'm asking for the creation of an organization with skilled people who will create a new campaign among legal immigrants. Kind of like Grass roots movement.

    I saw that. Looks like you are trying to pimp for a lawyer. Learn to stand on your own 2 feet first.

    All you have done is made a phone call to a lawmaker office. Before you start a poll go and meet your lawmaker and learn how to talk to lawmakers. That will be a good start.

    Ours was around 30 days after receiving the I-485 receipt.

    It is easy to hurt someone who is already hurt. Friends, I am with you all. I feel your pain.

    I would say - talk to pappu and other core and form a different channel in google groups or yahoogroups and organize yourselves first and collect more and more material needed for IV members and core to start working on these action items.

    Can someone stuck in backlog centers take this initiative and do it?

    I am sure a lot of volunteers shed a few pounds. beenwaiting shouldn't feel bad that you missed your gym on the last two days. See see another advantage of being at the rally... (unless ofcourse you loaded up on the reception desserts like me ;))

    kramer2005 is probably one of those folks stuck in BEC who were so happy when DOS released the July visa bulletin update. They thought it was unfair to them that we were allowed to file 485. And now that there is some hope again for us to file 485, these guys are back to discourage us from pursuing this further.

    Ok, we are stopping this stupidity. Happy?
    Let's all go home and do nothing.

    I believe there are good number of such cases. Besides me, I know there is one more person from Indiana who is also in same boat. In my case also, I was stuck in labor for more than 2 years and then had to wait for visa number being available for more than 15 months after I140 approval. As I mentioned in my first mail, my son was aged out by just 12 days ( after considering 29 days of I40 processing time ).I did not file 485 for him along with my application as I did not want to check chances with his F1 status.
    I would be more than willing to do whatever is required to gather support for our cause. If some one wants to send personal mail , pl do that . We can have telephonic conversation after that to see how we can join to-gether.

    I read it and seems to be complex to understand.

    My I-140 was applied in Mar 2005, when my son was 20. PD became current in Jul 2007 and I-485 was filed. I-140 was approved in Oct 2007.

    I have a question: Earlier, it was not possible for me to file I-485 for my son. Under new provision, is it possible?

    Did you I140 really take more than two and a half years to be approved??

    If it really did then that time span is subtracted from you sons age at the time you priority date became current. So if all this is true your son would not be considered aged out.

    Finaly received the 1-year renewal EADs today. This time there was no "approval notice sent" email/LUD.

    albertpinto and other folks who filed in April/May and still waiting...hang in there, you all should be receiving your cards soon. If you haven't already, try filing an SR by calling NCSC. I am not sure if that's what helped in our case, but it can't hurt your chances. InfoPass was useless in our case...the guy flat out said he cannot help us.

    Here's a quick recap of our case:
    EAD efiled at TSC May 27th
    Receipt and biometrics notices received: June 1st week
    Biometrics done: June 19th
    First card ordered email: June 28th
    InfoPass: July 28th
    SR filed through NCSC: July 28th
    Second card production ordered email: July 29th
    Cards received in mail: Aug 2nd

    got the second card production ordered email today. first one was on june 28th. hopefully this time, we'll get the approval notice sent email in the next couple of days...or latest in the next week or so.

    you cannot take one guy's response and generalize.

    Majority of EB2 members understand the problems faced by EB3. They are willing to work together. However it must be something better than the status quo.

    The strategies and solution presented must benefit vast majority of people rather than one specific group.

    I am totally against any effort that undermines one group and favor's other.

    Visa recapture is the only permanent solution to our problems.

    Hi,

    At last, our priority dates are current.

    Now, we have to go and submit Medical Examination Results.
    My Wife is pregnant and I was told by my friends that it is not a good idea to get her immunized (vaccines) now. She might probably have taken most of them back in INDIA.

    Is there a way we can apply for I-485 and get EID's without her immunization record? (I will have mine). I am sure there are others who are in the same boat.

    Please advice.

    Let me tell one example:

    If 2 of our kids are sick , we'll concentrate on both of them for their recovery.If one gets recovered we'll concentrate more on other kid.Now EB2 is in good shape and EB3 is not , now it's time to concentrate more on EB3.
    We took both of them to the doctor and the doctors treatment some how is working for only one... even if u change the doctor same thing..

    The online application system gave me a date of Nov 27th. I go to consulate on the scheduled time to find that the office is closed. That's really bad. Luckily here in NYC, I went on the same day on Nov 27th and it was opened. The passport was sent to me by mail and received it in 10 days. I was surprised by the way the crowd was handled. I think it depends on the top person who is in-charge of the consulate.
