    Definitely agree with herd mentality and haste, but can't blame them also. What if the dates go back again next month. So its a catch-22.

    good luck to everyone.

    What i am trying to say here is firstly reaching congressman should not be on the first day itself which some of the folks are doing, atleast wait for a a couple of weeks. and then regarding opening SR i would say atleast wait for around a week or 10 days at the minimum if you are scared of dates moving back. And yes i am not pointing fingers at any individual so don't take it personally "gc_on_demand"

    Hi Guys,

    Need some advice regarding two stocks.

    1) USO -- ETF for crude Oil. It is at about $29.00 but alst year in July it was about 120. IS it a good investment bet. I know I might have to hold it till summer of 2010.



    2) HNSN -- Biomedical device maker. It is the next ISRG, as the reports indicate. They make the sensie robotic cartherer devices. No one else in the world does that. What do you guys think of this ? It is now at $4.50, at its peak it was about $37.00

    USO is a typical criude ETF like AIG Crude - SCO etc .....HSNS is another medical Miracle company ....can pull rabbits outta hats (But hey this is a day traders analysis ....Not an investors)

    My investor side says there are other better(safer) longs for your money that this one.

    SGP are you working at Client's site in NJ or are you working from Home for a company in LA, CA ?

    If you are at Client Site then you need a LCA for NJ and no need for address in LA., CA

    If you are working from home, then you have to check what does your Paystub say, if it says that you are an employee in LA, CA you have to find a home in CA.

    It is from my understanding of the law. Other's please comment

    The HR Manager at my company wants to send a letter inquiring about the status of my 485 application. My PD is current as of April VB and my RD is within the published Processing time. My application is at NSC.

    my question is: what address do they need to send the letter to?? or is there another way to do it??

    The GOVT should state that those who apply for H1 should make it mandatory for the employees to be in US within 30 - 45 days of obtaining US Visas and be present in US on employment in continous increments of 1 year. And they need to show pay stubs continously.

    - Then we can easily filter out WIPRO, Infosys, Consulting company from misusing. For example Wipro will apply 5000 H1s and then send people when they eventually get a project, out of 5000, may be 1000 may show up in 6 months. So In this case 4000 H1s can get invalid. Indian companies find it sending people overseas is expensive business and would enjoy offshoring projects. If the govt makes this rule, consulting companues will be forced to start paying H1 folks from Day 1, no bench period, plus "Candidates need to show up in person immdlty in US". We kill 2 birds with 1 stone. 1, dummy H1s will not be applied, 2, if they approve H1s then they have to send engineers immdlty for which they may not be really ready, since they only anticipate projects and may not need so many H1s right away !...

    THis will be a sure shot solution.

    I did not take infopass appointment. I called the Customer Service on May 6th and opened a service request and today I got a request for evidence from USCIS. I am able to see this online but did not receive any letter. I think we should receive the letter by the end of the week...very frustrating...

    After 10 years of patience, myself and my wife's GC got approved today. Got email notification as Card Production Ordered.
    PD is May 24, 2006 EB2.
    Thanks to everyone in this forum for their information and especially to the IV Core team for their valuable information.
    I hope all the others will get their GC soon.

    Feel Free to suggest your recommendation.

    Just a suggestion:

    It may be more appealing to tie it with "five years of filing taxes as a "resident alien" including contribution to medicare ans SS taxes".

    In other words, any permanent legal resient (GC holder) who has filed taxes as a "resident alien" for five years while working in US and contributed to medicare and SS taxes should be eligible for citizenship filing.

    This should be added in addition to the current criteria of "five years of continuous stay after getting GC".

    Last month (July 17) I e-filed EAD and AP for both me and my wife. My wife's AP got approved couple of days back.
    I was looking at the receipt notices and observed that the priority date is missing on the notices. Observed the same issue with my 485 receipt too.

    Does anyone else have the same issue? Is that a problem?

    Hello everyone,

    Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :

    1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?

    2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.

    3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.

    Personally, we would like to do the first option, just get the H-4 restamping done in June and get back to US by July. But since she'll probably have an active H-1B starting in October, wondering if that will cause any issues when we go for the H-4 stamping.

    Here is a scene I was in:

    Paskal(Puneet) is driving - Sumita is sitting on the passenger seat - we have no idea where we are going. It is 2:00a.m and we are REALLY hungry and tired...

    Sumita "I will give you directions from my Tom - Tom " I think she meant GPS.

    Puneet (after taking several wrong turns) "It is not a Tom - Tom"?

    Sumita- " whateverer it is , it gives me directions and I talk to it" (She was spending 4 hrs. driving each day with this TomTom ).

    Puneet - "ok, let's follow our friends".

    Sumita dials.

    Vandana(in the other car) - "Yeah you can follow us".

    Puneet - "well where are you guys"

    Vandana - "We are trying to figure out, I don't know how we got here - Let me consult my GPS"

    This is what happens when you are sleep deprived, food deprived - all the gadgets in the world cannot help you.

    Jane( a chinese) - "why do you guys have to eat anyway, it is time to sleep???"

    Will my application selected if I get my ITIN number? I clearly understand that it is for Tax purpose, but as it also comes from the same department I am bit curious to know about it.

    ITIN number is issued by IRS (Internal Revenue Service). H1B is issued by USCIS (United States Citizenship and Immigration Services). IRS comes under Treasury Dept., USCIS comes under the Homeland Security. Don't see how the two are the same - other than being different branches of the govt.

    Having an ITIN number will not qualify you for a H1B automatically. You can get an ITIN number even if you are not in this country legally. As of today, IRS cannot share it's information with anyone - not even the police. As per IRS, even a thief must file income tax and the thief can take deductions for the tools he buys to carry out his trade :)

    My employer filed my EB3 PERM on 65th day after starting the process with a job bank posting, and after filing with DOL it took 11 days for the lawyer to receive the approval.

    Here is the reality: The thread is 2 years old and we have not had a group of motivated folks who could commit both time and money for this. In the last 2 years thousands have read this thread and have got greencard, but after getting greencard most people have different priorities in life. Writing posts on the forum asking IV to work on it will not get anything done on this issue. Nobody else will do anything unless those who seriously want to work on it commit their time and money for it.

    They need to be going to fund raisers of lawmakers and contributing to election campaigns etc as a first step to lobbying. We need to see IV green card and citizen members doing this more regularly anyways to help others in line behind them and get more politically active.

    Few things for GC holders to know:

    Here is how people can organize this effort:

    If some green card holders seriously want to work on this issue, the first thing they need to do is form a team. Commit for a long term effort. This is not going to be an effort for a few month or days but will take several years. After you form a team, the next task would be gather as many people as you can who want to work on this issue and wish to meet lawmakers. You will also need start-up money to work on this effort. This effort is not as simple as fixing green card backlogs. If we are thinking working on this effort will be as simple as writing emails, then it will not be worth spending time. Be prepared to personally go and meet lawmakers in both your area and DC every couple of months. IV core team has been making trips to DC every month for past 4 years and only then we have been able to bring our issue in focus.

    Citizenship rule change would change the INA and would require lot of support from H1B community, Greencard holders and citizens. It would require lot of funds too. Be ready to contribute your own funds (not hundreds but more than that to start) to run advocacy tasks. IV site is just a platform with a web-forum, but the real work that costs money is daily advocacy operations. Running is site is not expensive. Once the effort gains momentum, you can raise from IV forums from other Greencard members as a separate pool just like we did for FOIA.

    At this time IV does not have the bandwidth or resources to work on this issue. Our primary focus is fixing greencard backlogs so that our members are out of the Greencard Queue. We started this organization for this purpose and we wish to finish what we started before we take on any new effort. Even though some core team members have Greencards, we are all committed to work on Greencard backlogs and will not work on other agenda items in our limited time. It will have to be a parallel team within IV that can work on this issue. IV team can guide as needed but we simply cannot divide our limited time and resources on a new effort.

    I fully second Pappu's comment as the current IV core leadership does not have time/$$ to spend on Citizenhip. Getting GC for all of us has and should be the first priority. Thanks to IV core and many of us fellow volunteers, their effort has paid off as things are moving decently fast for EB2 for now. Hopefully our fellow EB3 friends also see some hope in FY'11. As I was saying in the previous posts, many big corps have not filed for new labors in FY'08, FY'09 which should free up many ROW visas. This should help EB3 in the near future.

    One of IVs priorities has been to have a uniform skills based system like other developed countries Eg. Canada.
    members are welcome to join in that initiative as weel and suggest ideas.
    I'm actually preparing a doc for a way to fairly convert people from EB to a points based skills system. This would also eliminate country based quotas as a side effect.
    The CIR in 2007 had a similar proposal, but they did not compensate those already in EB queues.

    There is a post from logiclife arguing against the points system back in 2007 (I will find that and post it here). Since when did IV change the strategy to go with the "points system"? The simple argument against the points system is that Government (and NOT the employer) decides who is qualifed in a points based system as against the current system which only allows qualified people with a job and being inside the U.S, to apply and get GC (as against the points system which can be from anywhere in the world).

    The current system can be and should be fixed instead of moving to the points based system. For instance, remove the per country quota, allow a non-immigrant visa to be converted into an immigrant visa by an employee without going thru the labor and I-140 after a certain amount of time (3-5 years) which takes away the hold of the employer on your GC process, increase the EB numbers etc.
