    Correct me if I am wrong. If a person has a good paying job and if he decides to foreclose, isn't he responsible for the loss incurred by the bank. It is a different case if you have no income, but just because you lost money because of a wrong decision, how could you walk away free with just a dent in your credit history. Maybe I am missing something here.

    BTW, I am not judging OP in any way, just curious with how foreclosures work as they make headlines everyday now.

    Today got the magic e-mail Card/ Document Production . Looks like the SR submitted 3 days back worked in my case. Prior to my SR the IO said that they don't have FP cleared, I called FBI and confirmed that they sent back my FP's and in my SR I request the IO to input the details that I got from FBI, Looks like that did the trick.

    All the best for the folks who are waiting for approval.

    The OP could try contacting the manager of the HR regarding the EAD thing before getting lawyered up. Clearly the policy, doubt there is one, violates whats stated on I-9. You are not asking CapitolOne for any sponsoring of GC. What if you are a derivative holding an EAD? Did they know that when they decided to quote this "policy" of theirs? Doubtful.

    And called the DOS customer help line to check if my H1B info is there in the PIMS system... what the lady told me is unless I submit my application at the US consulate abroad they can�t check the status .. Let me know if others have different experience...

    This whole PIMS thing becoming a pain for people like us :mad: ... wish they did import all the petition info first before releasing this system to all the US missions abroad...

    I was able to contact NSC using POJ today. Got same response- File is with IO for review.

    I could reach IO yesterday. representative said that me and my wife's cases are preadjudicated. Not sure if I could believe this...

    Atleast desi body shoppers does our green cards and also pays unlike TCS, Satyam, infy crap.They bring people on L1 visa and they pay so less and these people on L1 killing oppurtunities for US based people and they take the job to India. H1s are not the problem. L1 are.

    For H1s, we need reform and regulation of law
    For L1s, stop giving them or enforce the law very strictly. Or else everybody will be jobless

    I have seen this in my company, a wireless provider in east coast.They have been eliminating silently all US based resources for the past 1 year and replacing with L1s

    Why do I get this feeling that you are an anti-immigrant on this website?

    I also had my visa interview on 27-DEC-2007 @Mumbai (h1-b/h-4 renewal) and was told that I will receive an email in 2 business days, subsequent to which I will have to go to VSF office for getting my visa stamped.

    Its been 6 business days and am yet to receive an email..I contacted VSF in Mumbai and they told me that all the H1-B applicants are in the same boat and they could not predict any time line...Planning to call the US-consulate tomorrow to see if they can provide some timeline..I already have rescheduled my return flight to US...If things continue this bad, am planning to use my AP to travel back to the US.

    File a 7001 form with the Ombudsman's office. If I remember right, IV had sent in a recommendation for the USCIS to send GC in secure mail.
    An official complaint (instead of just email to ombudsman's office) will reassert IV's recommendation.

    Hello every one,
    I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
    Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
    What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
    Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
    1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
    2. If they have earned full 40 points in Social Security
    3. If they have paid the tax continuously for 10 years
    4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
    and
    5. If they do not have any criminal records in these 10 years.

    Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
    Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

    I would take off the point 4 related to owning the house as most of us are unable to do it just as greencard isnt in hand. I know how one can feel the pain of even owning the house without a GC, but trust me, there are very very few who would have bought a house with GC pending.,.

    I STRONGLY support Citizenship for anyone for 10 years in the US or waiting for 5 years after applying for GC. I have also voiced the same thing even before. Citizenship is what we need to request after this much wait,

    There are plenty of folks waiting approval like you including me as well... If your attorney has followed up with USCIS and if u have created an SR, thats probably the best you could do to let USCIS know that they shudn't b sitting on ur case...

    Lets hope for the best.... Keep us updated if u see an LUD or get an update...

    I was told I can't travel international after filling I-485.
    I can travel international only after receive the receipt of I-1485.

    Is this true?

    I don't see an answer to vsoni's question. I don't know the answer either. Can someone answer vsoni's question and also mine, please?
    Here is my question:
    I'm currently on an H1 visa status. I'd be applying for 485, EAD, AP on June 1 (my PD becomes current then. :) ). Currently I don't have a H1B visa stamp in my passport. I'm planning to leave for India immediately after applying for 485, EAD and AP and apply for visa in India.
    My question is if my H1B visa gets rejected, can I come to the US on AP (someone in the US will mail me the approved AP)?

    My spouse is traveling to India soon as her father is ill. She is on H4 visa, valid until next year, with pending I-485. She doesn't have AP at hand. Given that there is a slim chance that our pds would be current, would she get into trouble if she is in India when her GC gets approved?:confused:

    There are 3 broad areas where your app can be:
    1. In a huge storage area somewhere off site -> Contractor pulls out your app and transports it to NSC based on the list that NSC gives him.
    2. In a holding area within NSC. -> Waiting for IO to pick it up.
    3. On the desk of an IO.

    If your app is in either state 2 or 3, the response from USCIS will be "your case has been assigned to IO".

    My suggestion is ask them:
    1. Has my case been pulled out of the storage area? If not, could you please request that [An IO can do this and I think this was the most useful thing in my case. She said that she will make a request to the contractor to get my case pulled out].
    2. Has my case been picked up by an IO or is it still waiting in the holding area? If it has been picked up by an IO, nothing you can do except filling out 7001 form. If it has not been picked up by an IO, ask on the phone if an email can be sent to him advising that your case is current and waiting.

    So, broadly, your goal should be to get your app moving from state 1 to state 3. Once an app lands on IO desk, it will take between 10-30 days to get it approved.

    Same here, i got a similar response too... If they are true to their words abt under review, we shud b fine...

    But the problem is, they mite b stating this under review for all cases to avoid repeated requests and hence the issue..

    Is ur case also at NSC?

    How has ur luck been with the POJ method? Have u always recvd the same informn from all IOs?
    I always get a different response wen i talk to an IO at NSC...

    I got to know that my case is pre-adjudicated and with IO since Sept 20, 2009. But this information is not helpful at all as people have got GC's as early as Sept 01.
    Now, whenever I call-I get same msg- that my case is with IO and nothing can be done be done to expedite it.
    I have changed my employer only once since filing for 485 and been only with Fortune 500 companies as permanent employees,don't know what is holding up the case- all my coworkers got it by Sept 15th.
    My case is at NSC.

    ofcourse, all employees are protected against discrimination based on religion, gender etc.,
    that was not my point.

    I understand that a company CAN refuse to hire someone based on their visa status, such as h1, f1, and that is legal.
    But EAD is a different matter. It is not a visa. when the AOS is pending it is like a precursior to a GC and has similar rights or whatever
    I was trying to clarify if it is legal to refuse employing someone based on their EAD when their AOS is pending.

    One would wish that life was as simple as this, i did not get any hits but i am stuck for the past 3 years and counting :)

    BTW, the hits that FBI looks for is criminal or 'derogratory' as they call it, i think its just your luck, some get screwed some dont...


    Collected from some other forum . Just google search your name combinations ( within quotes ).

    For eg. if you have FirstName MiddleName LastName .

    The search should be ( put within quotes )

    "FirstName MiddleName"
    "FirstName LastName"
    "MiddleName LastName"

    and all the reverse combinations.

    If you get hits in 100s or 1000s , yeah you can wait 2 -3 years.
    This is observed from the names of Indians.
