Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.
A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?
I don't know if procedures are different in the consulates..In my country you apply for H1B visa ,they interview you and tell you that you will be granted a visa so we will call you when stamp is ready...you take your paaport and yoiu go home and whenever they call you for stamping you bring your passport and stamp it the same day...Are procedures different these days?

i wanted to share that i have recd by email confirmation regarding the GC production from USCIS (Aug 18).
I was, in fact, waiting for my fingerprinting notice - since my last one was couple of years old. My lawyer had written to USCIS to review the case and requested to send us a FP notice.
But what i got was GC production email for both me and my wife. My journey on H1b that started on Nov 99 has finally ended!!!:)

What Pappu says is right. Ppl have been so impatient that they're bombarding USCIS with SRs, emails, letters from attorneys, Infopass etc..etc...etc...I understand the anxiety but isnt this a bit 2 much? I was no exception to this. I raised an SR on the very first day my date got current and on trying to followup on the SR the very next week, I stumbled upon a clearly tired second level IO who didn't like the way I was pushing for it. He clearly explained to me that there was no need to worry as the dates were current and everyone who was current and cleared of security would be approved as there were several visa numbers available and he also told me that there have been thousands of calls received everyday and its becoming really hard for them to handle the situation. I could see how tired and frustrated he was. I immediately understood their plight and just waited without any further action and within a span of 15 days after that call, I got my approval. My attorney also advised me to wait as he was sure the dates were gonna be current the next month as well and followups would only result in delays.
Well I'm not saying its wrong to be anxious. Ofcourse, its an important milestone, one that secures our future in this country and yes, its only natural to be anxious. But being anxious doesn't mean that by calling or emailing or Ombudsman etc...ur case will be approved. Try and put yourselves in the IO's shoes as well. For a moment think what it wud be like to be an USCIS first lvl/second lvl IO receiving the same call every minute from a diff person and each one trying to reach the second lvl IO with lies such as my A# on file is diff than the one on 140 OR address change etc...etc...This is ridiculous. After years of wait we resort to such shameful behavior towards the end.
Yes when others with later PDs are getting approved and u r still waiting, it does bring out frustration in u. But u should also put in thought as to why that could be. Maybe one of the security checks in ur case is awaited or maybe ur file is on some table waiting to be picked up etc...I was venting out my anger and frustration during my wait on this forum and ppl were only asking me to do that, do this blah blah blah. I just waited nevertheless as I knew the moment I spoke with the IO that there was really no point in following up as cases were getting approved and USCIS was definitely WORKING as hard as they could (even on weekends) to clear all current cases.
There was one dumb idiot who called and spoke to the second level IO (per his own words "just to confirm") even after getting the CPO email. I mean how foolish and idiotic is that. Since the forecast is EB2-I will be current in a few years. Does that mean that someone with a PD of 2009 (EB2) would get the GC faster than someone with a PD of 2004 (EB3)?

The flower campaign has been a spectacular success. Lets not dilute it or confuse it with food or pizza campaign. Lets the free flow of flower campaign contunue.
There is a symbolism of peaceful protest behind flowers, its universaly understood, what is the symbolism behind sending food, it might be misunderstood. Lets not overdo it.

So, now lets sit and watch. And if you want to send more something, then better send more flowers to USCIS,DOS and even to walter's hospital instead of sending pizza!!!!! USCIS has decided that the flowers sent by skilled, legal immigrants to director Dr. Emilio Gonzalez will be forwarded to injured service members recuperating at Walter Reed Army Medical Center and at Bethesda Naval Hospital.
We welcome the fact that Dr. Gonzalez acknowledged the symbolic gesture of our protest. We are even more happy that these flowers will brighten the day of our injured service brethren. Can we do a blood drive next as protest! seriously. Donate blood as protest and for media attention.
I totally support the blood donation idea. I am pretty sure, a blood donation drive would be front page news on American Red Cross web site also. It should send out a message that the GC is so important to us.
The actual collection of blood hopefully will be fully carried out by the American Red Cross.

If not today, some of us EB3 folks may want to port. So it will help more people to port and also to compensate to some extent the #s coming into EB2 pool from EB3.

Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..

Also, how is the spillover going to be distributed among EB3? First EB3 ROW and then EB3 C/I as in the old system?
Personally, I think the visa recapture bill would help things quite a bit.

1) why the USCIS has a duty to adjudicate any application properly filed with them
2) why 8 USC 1252(a)(2)(B)(ii) does not bar jurisdiction in AOS mandamus cases
3) why the duty to adjudicate does not depend on a specific statutory or regulatory timeframe.

when talking to my friends about IV I have observed the following:
1) they prefer to "visit" the iv site to get a first hand look at what IV is about
2) they tend to classify IV as a discussion forum rather than a movement - a couple of people have said that they did not notice any difference between IV and the other boards. they bookmark it and come back only when they have a burning question.
3) once i tell them about IV's achievements they do seem interested but most appear to be afraid (or lazy?) in actively joining - either monetarily or otherwise.
4) some people do not even want to post questions actively - instead ask me the question and expect me to post the question/ help them out with a response (not sure why - privacy issues?) - have others seen this also?
I don't know how to convince the lazy ones - but for the others, would it make sense to restructure the site a little bit so that the home page is a little less noisy and has only information about the underlying movement , IV's achievements and then has a link to the the message board (as a feature of IV rather than it defining IV)?
