1. Get a letter from Senators and Lawmakers, that those H1B guys who have contributed to the economy by filling patents and doing reseach should get out of the country. I will be the one to get out first.
2. Lean this, business are been done to make profits. Employers in this country think about themselves not about you. Check John Hanity show and they will teach you the fundamentals. If employers don't earn any profits they won't do a business.

nrk, how long did it take after the status got updated to "Approval Notice Sent" to the cards received by you? I am assuming that "Approval Notice Sent" on 485 is actually mailing the cards out to the applicant. ( That is what happens on 765 (EAD) application all the time).

I'm a great fan of Obama for what he has achieved so far and in all probability he will in Nov. I hope the new CIR will not be similar to CIR 2007 as far legal immigration is concerned. After 8 years of paying taxes I would definitely feel greatly disappointed if we get a raw deal for being legal

But that appeal came only after Mr. Bush issued a much sterner one first -- for tougher enforcement of immigration laws, more vigilance on the border and an immigration policy that "reflects our values."
The message Mr. Bush delivered to lawmakers is the same one an increasingly vocal anti-immigration chorus is sending to him: First get tough; then we'll talk.
Mr. Bush was cheered by an unlikely alliance of pro-business Republicans, Democrats, unions and immigrant groups when he called for a guest-worker program in his State of the Union address two years ago. But the idea has hit a wall of opposition from the party's cultural conservatives and security hawks who first want to stop the flood of illegal immigrants into the U.S. (See related article.)
In December, the House of Representatives passed legislation that would, among other things, extend a short wall on the border with Mexico to 700 miles. The Senate, which had planned to overhaul immigration laws when it takes up its own bill in a few weeks, now also is under pressure from some Republicans to toughen border controls first.
As immigration soars to an all-time high, that get-tough argument is gaining political steam. With the 2006 elections still 10 months away, a half-dozen candidates are running for national office on pledges to stop illegal immigration. Bills on the issue, many denying benefits to illegal immigrants, have been introduced in 31 state legislatures.

But for all the emotion immigration is stirring up, political operatives in both parties warn that it isn't an issue that rallies voters. "Will this impact your electoral ambitions?" asks Ryan Ellis of the conservative group Americans for Tax Reform, who has studied the role immigration played in recent elections. "All history has indicated 'no,' whether you're in Arizona or Maine," he answers.
It didn't prove a successful strategy for the Virginia governor's race in November. Republican Jerry Kilgore seized late in the campaign on the issue of taxpayer-funded job centers for illegal immigrants, and in a stinging television ad asked of his Democratic opponent, "What part of illegal does Tim Kaine not understand?" Although immigration was only one issue in the campaign, Mr. Kaine won with 52% of the vote.
Likewise, in December, in a special House election in California's Orange County -- where illegal immigration is a flashpoint -- Jim Gilchrist, founder of the Minuteman Project, a volunteer border-patrol group, won just 25% of the vote.
Mr. Ellis of Americans for Tax Reform also points to seven 2004 Republican primaries where immigration-restriction candidates never won more than 46% of the vote. Among those beating back challenges: Arizona Congressmen James Kolbe and Jeff Flake, who are sponsors of a House bill that would let illegal immigrants earn legal residency in the U.S.
Candidates who want to restrict immigration seem not to fare well because very few people worry enough about immigration to vote on it -- even though many of them tell pollsters they're worried. In the Wall Street Journal-NBC poll, 78% of those questioned favored "tightening" the border with Mexico -- but only 7% said illegal immigration was their biggest national concern.
Immigration is "a loud debate that produces few voters," says Frank Sharry, director of the National Immigration Forum, a Washington immigrants-rights group.
But that doesn't mean immigration won't be talked about this campaign season. Most prominently among 2006 candidates, Rep. Tom Tancredo, a Colorado Republican, is toying with a symbolic run for the White House. Among other things, Mr. Tancredo wants to deport the estimated 11 million illegal immigrants now in the U.S. and deny citizenship to the U.S.-born children of illegal immigrants.
Immigration restrictionists also have announced runs for governor in Colorado, for the U.S. Senate from California and for a smattering of House seats. San Diego's Mr. Bilbray is running in an April primary to succeed former Rep. Randall "Duke" Cunningham while also pursuing a class-action lawsuit that would prevent California public colleges from offering in-state tuition to illegal aliens.
Some state legislatures are considering extending in-state tuition, health benefits and driver's licenses to illegal immigrants, even while others want to ban such benefits. In Ohio, a statehouse Republican has said he is considering an amendment to the U.S. Constitution to exclude illegal immigrants from the census counts that are used to apportion Congressional seats.
Bills in New Hampshire and North Carolina would require local policemen to enforce federal immigration laws, and one in Virginia would require proof of legal residency to obtain a marriage license.
With Republicans largely leading the anti-immigration charge, the issue is causing heartburn for the national party, which was hoping that its generally pro-immigration stand would help it pick up Hispanic voters. Twelve years ago, California's Republican Gov. Pete Wilson won re-election in part by campaigning for a ballot measure that would deny benefits to illegal aliens -- a rare instance where an anti-immigration stand won the day.
But a decade passed before Republicans won the governor's office again, and they still haven't won back Hispanic voters. "It was a metaphor for short-term gain, long-term loss," says the National Immigration Forum's Mr. Sharry.
Republican pollster Ed Goeas says he urges his clients to talk about solutions to illegal immigration instead of focusing on emotion-charged issues like immigrant job centers if they want to win. His firm, the Tarrance Group, does polling for several immigration-restriction candidates, including Mr. Tancredo, he says.
But in anticipation of the 2006 elections, he's also running voter focus groups to help candidates handle such volatile issues as amnesty for illegal immigrants and whether to allow guest workers to eventually stay in the U.S. After voters let off steam, he says, focus groups show that immigration "becomes a very reasoned conversation very quickly."

you need to fill out A#'s assigned with first applications..
if both r filed on the same day ....then there is no way u can mention each other on application...
my lawyer said if if it is filed like that ...u can combine the two applications when u get the receipts...

This is a real problem. I got a letter from a prospective employer, who wanted proof that I was legally eligible to work in the US (alongwith transcripts, previous employment letters etc.) prior to scheduling an interview.:cool:
I believe employers are seeing a lot of candidates on EAD, and for whatever reasons they dont think EAD is good enough and would like to weed those candidates out beforehand.
We need to fight back against this discrimination.:mad:
I think h1b was considered as an initial filtering criteria where they do not have to deal with complexity. Now as they see more EAD trying to switch jobs, they are trying to apply the same filter. They do not understand that EAD is a valid document on the i 9 form.
So what if they find a lot of GC holders?

Hang in there. We filed on July 2 as well. Checks got cashed yesterday. Receipt notices have been mailed from NSC. You guys should expect to hear something anytime now.

Lawyer is sharing info that some of their client have got fee invoice from NVC. I have done family based application through NVC for my parents and I know you get fees invoice almost 4 months prior to your GC interview date. So lawyer is thinking that NVC is thinking to go upto Nov 2007 in case if CIS fails to act on enough cases in last months.

Some IV members were in DC at USCIS building yesterday (Tuesday, July 10th, 2007) from 10 AM to 1 PM. There were reporters there including CNN-IBN and Voice of America (Aaj Tak chanel) with video cameras. We saw the deliveries of flowers being made by UPS and FedEx. The DHL guy told the flowers were already delivered in the morning in the big truck. The security guards at the loading dock of USCIS were not allowing Video Shooting after the reporters shot the UPS deliveries going inside. When the FedEx tuck came in, they made him park right near the Loading Gate and were trying to cover up by parking two other vans each side of that truck so nobody can shoot the delivery.
Then IV members went inside the USCIS building from the main gate to hand deliver the flowers with Get Well Soon ballon and card for Emilio Gozales. Teh Video cameras followed until the security guard asked them to stop the recording as they didn't have prior approval. The security guards, receptionists and people around were smiling by seeing the flowers for Gonzales. They let the IV members proceed towards the visitor area. Where another secuirity guard asked who the delivery was for and directed to one of the Gonzales's secretaries, Rachel, who accepted the flowers. There were people around her. Rachel said to them "This is creepy, as far as I know he ain't sick, we received flowers last week, they were pretty too. Yesterday someone sent him cookies. This is some kind of peaceful protest". Then she also read the card in front of IV members. IV members asked her about the website update which says they are sending these flowers to Walter Reed. She said yes, we are doing that. IV members thanked her and left the building.
On the other side, the reporters with cameras were asking for approval to shoot inside. They made them wait and then several people (from different level of securityty to management) came to talk with them and finally said they can not allow to shoot for security reasons. The reporters also didn't miss to ask them about flowers campaign and apparently sent the message and hype about the campaign to top level.

EB1 (16K this year, conservative based 12K-24K possibility)
EB5 (8K, has been consistent)
EB2 ROW (10K, last year only 9K, and EB2 ROW has been consistent)
EB2 I/C 6K
Total 40K
EB3 porting 6K, ppl missed the 07/2007 w PD b/4 07/2007, 1K
EB2 I/C inventory at the beginning of Oct. 2010 (since we calculated based on normal EN2 I/C 6K, 5800 exactly). 34K. DOS show 32K while CIS inventory showed 34.8K, and we should have some approvals for ppl filing who missed 07/07 w PD b/4 07/07
So it looks like it can just clear all 07/2007. WOW.
I am sure DOS and CIS have better communication now, and they should.
The Million Dollar question will be
1. DOS will have to release some visa number early, if they don't want to waste visa, considering CIS can only approve (say 8K per month even with pre-adjudicated cases)
THAT IS WHY THEY WERE SAYING MAY. And the EB1 trend takes some time for them to declare it, mostly EB1 India bodyship crack down from late 2001.
2. DOS/CIS will consider those in approvals
a. There will be new filings EB1 EB2 ROW, EB1 I/C who missed 07/2007 w/ PD b/4 07/07. BUT processing time is about 4 months, so they could and must file in May to get it approved be end of Sept 2011 (fiscal year end of 2011). THAT IS WHY THEY WERE SAYING MAY as well.
b. After May, they will have good idea of 2a (EB1 EB2 ROW, EB2 I/C) total approvals this year. So in June July Aug. they will approve (EB1, EB2 ROW, EB2 I/C) who filed before end of May, and ALL REST NUMBERS (ALMOST CERTAIN FOR DOS/CIS at that time), AND START EB2 I/C SPILLOVER, maybe divided by 3 MONTHS, or FRONT LOAD

I believe that we will get 14-15K from EB2 ROW, EB1 = 12K (currently) + 6K (Minimum), regular cap I/C 6K. Eb2 row usage is down to 60%.
Total Numbers = 14 + 18 + 6 = 38K.
Now total demand is not just 34K demand data we also have porting and new filings especially from May - Jul 2007. My assumption of porting has been 6K out of which 2K have been approved.
So really its almost an exact match till Jul - Aug 2007. We should wait for the May bulletin thing to come true firts I believe VDLRAO gave a great calculation for that.
EB1 (16K this year, conservative based 12K-24K possibility)
EB5 (8K, has been consistent)
EB2 ROW (10K, last year only 9K, and EB2 ROW has been consistent)
EB2 I/C 6K
Total 40K
EB3 porting 6K, ppl missed the 07/2007 w PD b/4 07/2007, 1K
EB2 I/C inventory at the beginning of Oct. 2010 (since we calculated based on normal EN2 I/C 6K, 5800 exactly). 34K. DOS show 32K while CIS inventory showed 34.8K, and we should have some approvals for ppl filing who missed 07/07 w PD b/4 07/07
So it looks like it can just clear all 07/2007. WOW.
I am sure DOS and CIS have better communication now, and they should.
The Million Dollar question will be
1. DOS will have to release some visa number early, if they don't want to waste visa, considering CIS can only approve (say 8K per month even with pre-adjudicated cases)
THAT IS WHY THEY WERE SAYING MAY. And the EB1 trend takes some time for them to declare it, mostly EB1 India bodyship crack down from late 2001.
2. DOS/CIS will consider those in approvals
a. There will be new filings EB1 EB2 ROW, EB1 I/C who missed 07/2007 w/ PD b/4 07/07. BUT processing time is about 4 months, so they could and must file in May to get it approved be end of Sept 2011 (fiscal year end of 2011). THAT IS WHY THEY WERE SAYING MAY as well.
b. After May, they will have good idea of 2a (EB1 EB2 ROW, EB2 I/C) total approvals this year. So in June July Aug. they will approve (EB1, EB2 ROW, EB2 I/C) who filed before end of May, and ALL REST NUMBERS (ALMOST CERTAIN FOR DOS/CIS at that time), AND START EB2 I/C SPILLOVER, maybe divided by 3 MONTHS, or FRONT LOAD

My labor (EB3) and 140 were approved a while ago.My company has sent H1B extension for three years in Feb 07.There was a query requesting for additional evidence from USICS in Apr 07.They are requesting lot of my company info and nothing about myself.My Company is taking its own sweet time to respond.Now I am eligible to file 485 as per the latest June visa dates for EB3.My question is could I file 485 when H1b extension is pending.My previous I94 expired on May 07.Please help as it is urgent.If the visa dates move back again then it will be horrible.My Company didn't file during concurrent filing and has eaten 2 years of my life and now they may use this to further hold me..any help will be appreciated.

This is my case:
I am not working with my GC (I140) sponsoring company. I applied 485 based on that 140 from my previous company.
Got 3yr H1extn (from Vermont, EAC, in Dec 2007)for current company based on that approved 140.
Got EAD , AP approved.
My previous H1 visa expired in 2004. ( 4yrs gap)
Is it better to go to consulate (Chennai) for stamping ? or use AP?
If I use AP, at POE ( Newark EWR)if I were asked why I am not with GC sponsoring employer what should I say ?
Is there any issue for going stmaping after a long gap ?

I agree we might not always have hard evidence unlike the OP here. And lot of employers might be doing this. I have never faced this, yet. However, we have to act on it. The first step is to complain to the govt. Maybe if there are lot of complaints, govt will investigate and find the dirt, and fix it.
Another idea is to bring it to the attention of the job boards that discriminatory ads should not be posted. Lets give this a try.
To those effected, write to the govt if you are in a situation where you can.
Right but the here problem is that how to come up with written evidence of discrimination? These jerks do not send you an email "Hey, we do not consider EAD". Their pattern is generally as under.
You get an first email for their interest as your resume matches teh job
description and they want you to spit out everything in your reply
Say you have written " Authorized to work for Any employer in USA" for
work status, they do not communicate to have you spitted out specifics.
They call you. If you do not spit out, they would not go ahead. If you spit
out "EAD" smart ones do not even talk further and you find all
communication stopped. Now this is my own experience. Tell me how can
I convert this into "evidence of discrimination". Even if I have tape
recorded conversation, that guy did not utter any single word after I
spitted out "EAD"

What if the USCIS suddenly realized that they can make more money in August due to the fee change? So someone in dept had a brainwave thinking - why not move back the dates in July and move forward again for the August bulletin??
