My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

You can dissect it a million ways from here to sunday, the fact of the matter is that EB 3 as a whole and E3 I&C in particular are messed up big time. We cannot sit twiddling our thumbs while we wait, most EB3s have supported most of the action items. What is wrong in exploring different options. we are not obstructing anybodys efforts. Vertical allocation or horizontal allocation doesnt matter, what matters for most is that there should be consistency in actions. They keep changing the rules every couple of months. if we know the number of people stuck in each category per year/per country we can come to our own conclusions and decide if we want to stay or go. There are greener pastures everywhere. Every year our lawyer tells us that its a matter of 12-18 months and you keep waiting...the only reason is that...we have been waiting so long, lets wait a couple more and see. i know some will immediately give comments like, 'leave sooner, one less family in the queue'..or..'port to EB 2 you ##$@'...to them i say i hope you are fortunate enough to avoid getting trapped in a situation like us.

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

I like the new plan , may be I might buy it but if vonage has done this there will tons of other companies who will slash the prices or atleast match vonage.

StuckHere: As a backstop, do you have AP in hand? If yes, my attorney has recommended sending a letter withdrawing your H1-B stamping application to the consulate where you interviewed. Then with a copy of the letter in hand, and with your AP, seek to reenter the US on your own terms... Good luck...

L-1B - Speciality Skilled ones.. MOST ABUSED category of L visa... petition for these resources would be for a internal tool / custom product and they tell the same during consulate interviews BUT mostly gets deployed to consulting assignments. For Eg. A java programmer would have a petition which talks about a custom product / internal tool where programming language would be java once the visa is stamped these resource would be placed on Java project which has nothing to do with his petition and HENCE THE VIOLATION.
Blanket L1s - Blanket petition for a large group of resources from a company ... now a days USCIS & consulate doesn't allow these companies to use this category as they found this was one of the most abused category. Once again the process of sending these resources to other projects remains the same once the visa is stamped.
ALL THE ABOVE VISA categories are banned from either
1. Working on a client managed project (staff augmentation purpose).
2. On any technical skilled projects other than the specific internal tools/products mentioned in their petitions (both when client/their own company manages the project).
PLEASE REFER L1 REFORM ACT OF 2004.
Approved L1 petition is the final word in deciding what kind of work the resource can do here in US... not outsourcing companies greed.
Hope your doubt regarding the L1 visa categories is cleared.. I'll give the details of how these outsourcing companies work and how to bust them by reporting to ICE/USCIS in the next post.

When I call through vonage phone, the wireless internet connection to other computers is getting lost. Is this the problem others have too?
Is it having another router in between your vonage phone and cable /DSL connection solve the problem?
Any thoughts? Has anyone inquired this with vonage folks?

Finally, we got the approval emails for self & wife.
I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-
1: The review was complete
2: Visa numbers were requested 2 months ago and all security/prints are current
3: Files have been forwarded to officers for completion.
In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.
As others have mentioned IV has played a big part throughout this journey. Thank you again.

Hi,
I'd appeared for my H1B (F1 to H1) Visa interview on the 4th Jan at Mumbai. After almost 4 hours of waiting, the visa officer told me that they were unable to view/ verify my I-797 info as it was not updated in their Database. I was also told that this is an existing issue and that I should ask my company lawers to contact the Immigration Services office at DC. On being asked she told me the eta was 7-10 business days (or however long it takes for the info to get updated). I was then given the yellow slip and asked to submit my passport for stamping, after I receive an email indicating that my data is now updated. it's been 8 business days since my initial interview and I still haven't received any emails or calls.
1) anyone who interviewed on or around 4th Jan who has received a call or email?
2) Anyone who's aware of the procedure by which my company can expidite this issue (maybe through our lawyers)
3) any additional info on how long the wait might be?
I was told that on the 27th dec there were about 350 H1b pending cases (yellow slip) at the Mumbai consulate and around 150- 200 similar cases the following days. A freind of mine who appeared for his H1b interview on the 7th breezed through it with no issues.

Last year from October 2009 to February 2010, 22,000 EB1 numbers were used. During the same period this year, only 10,000 to 11,000 have been used. EB1 will be current worldwide all fiscal year. This will free up an estimated 12,000 visa numbers to fall down from EB1 to EB2 this year

Anyone have any ideas on what EB3 Rest of World will be in the October Visa Bulletin. My Priority date is OCT 2005 EB3 Rest of World. Do you think I have a long wait?
I believe you wait will be predicated only by processing delays.
Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?
USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.
But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?
Yes, at least one immigration attorney disagrees with the current interpretation, however he feels that the laws, as written, gives USCIS/DOS the wiggle room to deflect any lawsuits. Since the law does not deny EB3 the numbers, I think we should start a letter campaign to bear upon USCIS/DOS to take a second look at the law and fine tune their interpretation.
We should also ask other immigration lawyers their thoughts (some who have online chat/discussion).

That's exactly what I wrote a few posts above. I think the more basic question is - What does 485 inventory mean? Is it already filed 485 numbers or "can be filed based on approved I-140" numbers?
To the OP: Can you provide the link from where we can open the PDF instead of just throwing the PDF open. Maybe that will provide a better context to the numbers.
If these are pending 485 applications at USCIS, Number of pending applications with PD later than JUL 2007 should be zero.
If these are labor filings, they probably dont include dependents.
