I have to disagree with that. Check out the names in the Writs of Mandamus lawsuits or the thread on Immig Portal about people filing writs of mandamus (http://boards.immigrationportal.com/showthread.php?p=173311)-- it is not "only Indians." It is anyone whose name, when run through FBI's name combination algorithm (http://www.cyrusmehta.com/related/Ayetes_Memo_on_Name_Checks.pdf) (see pg 2 onwards in link), generates a hit in the FBI reference files.
Just for the sake of illustration -- check out the names that appear in this google spreadsheet (http://spreadsheets.google.com/ccc?key=pBQx8tqZHHU2A6Q-Pv9sULw&hl=en) (you need a gmail account to view it) with a list of significant recent mandamus rulings.

Two weeks is substantial considering that in May EB2I movement is supposed to 0 days. :)
On a more serious note, Shusterman had to adjust the statement because everyone is going to question their credibility when the VB comes out and if it is only 2 weeks and not the 'years' that they claimed. Shusterman is just another person who spoke too much too early.

I'd posted a note earlier. I haven't received any updates yet. I am in contact with 4 other people who interviewed on 4th Jan and are still awaiting a reply. your ad shows a company that has advertised for no EAD, GC h1b etc., which is legal, AFAIK.
It is not a small difference, but not interviewing someone based on whatever is probably their prerogative (even this may have certain limitations like -you cannot say "no women" et6c.,), visa status is not considered a protected class... again AFAIK. They probably cannot say no GC, but CAN say only citizens because of some clearance required etc.,
This is different from getting someone through the interview loop, making an offer and THEN saying sorry we ont hire you now because of EAD. That is BS. As for saying no to H1B, we have all been there, a company that does not want to sponsor cannot be MADE to do it.

I agree. The companies should feel the pain. our cause should get sympathy from the americans. We need publicity for our causes.

However I must tell you that being hostile towards companies will be counter productive to our cause. Infact we'll have to work with the companies and organizations formed by multiple companies. They may or may not help us, but being hostile to them won't help us one bit.
Pls come up with any suggestions you may have towards this.

Based on the June Bulletin, I will be filing my I485 in June.
Now, I have H1-B(with my current company till Feb'2010 that I just got approved a month back.(not stamped in passport yet)
-- Should I file EAD for myself ( I probably would want to change jobs after 180 days) ? Or is it better to be on H1-B.
-- Should I file AP for both myself and my wife(she is on H4) ?
Also, when I decide to change jobs using AC21 rule, is it better to tranfer
H1-B to a new company or if I have EAD, how does that work ?
Any inputs will be greatly appreciated..!!

If I were you, I would apply for EAD and AP for spouse and self immediately. You never know when you may need it. Say, your company announces a merger and your entire department is wiped out and you have to leave before coming Friday. It would be almost impossible to find another employer who will send the new H-1B application before Friday. In such instances EAD will help to keep you in status. EAD card for spouse will allow her to apply for SSN and thus Drivers license. AP for wife will help to travel out of country after you have used EAD. So in short, I would apply for all the docs for all members of the family. This could result in spending couple of hundred dollars but will help secure peace of mind.

I think you should be able to file the 485 yourself. The form is simple. If you can get a lawyer to do it and get all the appropriate 140 approval docs- the better, but I don't foresee any issues "doing-it-yourself".
Advace Parole is a travel document that lets you return back into the US without a H1B stamp on your passport. The AP has to be renewed every year along with the EAD (employment authorization doc) card.
Hope this answers your question. -- Now lets go back to sending faxes and calling senators.

Opened a SR on 7th Sept and wrote a request to local Congress man.
Approval: 10th Sept
Got a email approval for spouse on 10th Sept ! No changes seen in my status online but I got a response for my SR request that my case is also approved on 10th Sept, the email from SR came on 10th Sept.
Till date no changes to my status online but when you call the USCIS toll free number, I do here my case is approved on 10th Sept.
Just sharing my experience and thanks to Immigration voice forum.

Multiple 485 and EAD filing

Hi,
My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.
The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.
Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).
Any inputs or clarifications will be greatly appreciated.

I really don't know why someone would file the 485/EAD through the spouse when the spouse is planning to change the career field, and you know that you need to be in a similar job description to work on EAD. It almost seems like a no-brainer that the guy in this case should have filed for the 485/AP/EAD.
