1) Faith in IV -- Look at what they have done till now ( we all know about it )
2) Just too Lazy to contribute - Shame on you !! your Advance Degrees and High paying jobs your BMW or Audi are no use if you ask me ( junk)
3) too stingy to contribute-- Shame on you again 20$ you save now will result in 20k Loss in the future be prepared
4) Do not Care -- Too Bad its now or never ( many fall here i thing ) they just want to njoy the results

I agree with the contents of the post. Personally, I have been writing letters regularly to the Congressman, the Senators of my State and also to the President. In most cases I have received responses.

I think we need to grab the the opportunity for this "Diversity Lottery Bill" and keep it alive and on forefront. If this happens, it will be a boon for EB category.
If you are not already in, you can make a team from people from the group "Want to file I 485 thread" so that we can have a team of 20-30 dedicated people doing the same advocacy what you two guys are doing.

I changed job early this yr and my new employer is working on labor for me right now. But from my previous employer I have PD of Aug 2005. If I get my labor cleared in a month, i should be allowed to apply for 140 and 485 since other fellows from 2007 pd were also able to apply recently.
Why should i suffer because of USCIS foolishness in Aug.......after having PD of 2005.............all similar cases lets raise our voice.

I agree that going through this again next year is irritating (which is euphemistic, at best), but...
assuming for a second that CIS is willing to give you a replacement card with 2-year validity, are you willing to send them the card you have finally received (after another nerve racking wait) so they can process your request? I don't think so...
BTW, there's a guy on Ron Gotcher's forum who's been issued a 2-year EAD eventhough his dates have been current for the last 4-months. Check this out: http://www.immigration-information.com/forums/showthread.php?t=5855
so CIS is issuing 1-year cards to some folks whose PD was not current when the EAD application was approved...and 2-year cards to some whose PD was actually current. typical CIS stuff...
I wonder for those who have got one year cards, if this would help - call USCIS and point out the inequality ...or maybe say that by mistake they sent 1 year when they should have sent 2 year ..would that help ..any thoughts ??

Hi abhisam - I did the same. What happened to your EAD renewal application.?
my application was forwarded to the phoenix lockbox. My checks were cashed from phoenix and then the application was sent to Texas. I recieved reciept notice dated april 16from Texas Service center and am waiting for the approval. I had read in some USCIS press release that if you send your application via usps then they will forward it to the correct center but if you send it via fedex or other courier service then they will return the application to you.

I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,

I was not aware of these things(EB1 gc for false managers). Smart people all around. In fact sometimes USCIS does checks on approved cases and those do get it by falsifying stuff will go to jail for a LONG time, long enough to get citizenship here in US!!
We should all report any illegal activity. Keep in mind that we all will be affected by it by USCIS reviewing everyones case too thoroughly... Bcos we all are Aliens!!(short ears, no hair... like in a sci-fi movie)

EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:

Today its very windy and a bit cool outside.. I'm going out there to test it out.

In times when the temperature drops, try wearing a headband to keep the cool air off of your forehead and also try wearing a hat. I do look like a running geek, i have on hat, sun glasses and headband. But after 10 years of running, i don't care if anyone laughs at me. At least i know I am comfortable!

My wife have H1B approved in 2005.Her stamping was refused on 226(g) section.She came to u.s.a on H4.Now her employer has applied for premium H4 to H1 transfer for her.
We didnot hear anything from them.It is already 2 weeks.
If it goes through.Does she need to go back for stamping to start working.
How the things will be?
How long the process will take (transfer)
If the attorney can help me in this,it is really great and appreicable

Even if you succeed in changing the law and change interpretation of spillover, you won't see much difference in wait for GC.
Only EB3 folks who have PD in 2002, 2003 may greatly benefit by this. Rest of EB3-I will have to wait for atleast 5-6 years.
We should instead concentrate on Visa recapture.

weldon springs, follow my posts. you are right, TSC is doing a better job. look at my previous post, they even renewed my Ead from the date of expiry of the previous one, so that we dont pay money for nothing. my EAD got renewd in exactly 4 days..
I am feeling very envious of people having their applications processed at the TSC. TSC as seen by the examples above are renewing EAD in 2 weeks.
However, NSC is taking 2 months to process these EADs. There is a big difference between processing logic at NSC v/s TSC
I think the employee diversity at TSC is big compared to NSC. Therefore, people add their heart to work and processing is faster. In other words, Intent is pure. If you pay a higher fee for a service you get the return.
Contrast that with NSC. The employee diversity is poor. Employees are working just because it is a government job and their intentions are questionable, therefore a big lag in processing.
Hope the courts teach NSC a lesson, that nobody is above the law and they should be processing cases quickly as compared to their TSC counterparts. Hope somebody is listening.

Kennedy's staff picked up something from their old files...like the original McCain-Kennedy bill of 2005 (the CIR before it hit the judiciary committee last year) that had the hard country cap and slapped it on Thomas against Session's amendment.
If you look at the text, its remarkably similar to the original McCain-Kennedy text (140K to 290K, hard country cap, recapture...all that. Even the description of the title).
They copy-pasted the text for skilled immigration from original McCain-Kennedy that was their brainchild, instead of copy-pasting it from S 2611 ES what had all the amendments from last year's senate CIR. But then again, copy-paste is very common on the Hill. Last year, Bill Frist copied the entire Judiciary Committee version and introduced it after deleting 2 titles related to Amnesty and guest-worker bill.
If this amendment had really passed, and if it had not been modified in the conference between house and senate and if hard cap had become a law, then this amendment would have done more harm than good.

We do not get any attention, because we do not raise our issues and we are not vocal about the problems we face.
.... But we as a group need to stand up, talk about the issues we face and have our voices heard.
You made very good points. May I suggest we ask members to call on the phone too if they're busy? This actually worked in delaying the first Bailout in 2009, when they received numerous calls.
Customer service reps do this for hours everyday in some places.
