My attorney sent an email inquiry to DOL regarding my case. Within less than 12 hours a response was received -
It sounds like a pre-written text that goes to every inquiry they get.
Thanks for sharing your experience, I dont buy into their FIFO process. May be its applicable in the Non-Audit cases but cases that get audited are just being piled up at someone's desk and that person is most likely dead (does not exist) :mad:

BharatPremi Please tell me I am wrong! i collected some data... and just by looking at it... it seems like EB3 will move very very slowly not as per your prediction! I m not a stats guru perhaps you or anyone who is a stats guru can shed some light here!

I think EB3 movement will be very slow based on above calculations
EDIT: Even if Unused Visas get funneled down to EB3 India > cut the time in 1/2 still looks like 4-5 years to clear EB3 < 2003

Let me start saying that I am not 'stats guru' either.
My simple way of looking at it is the way it happened in June-July 2007. Why did they open the gates? To use up the VISA numbers for the FY.
What can they do to do the same this year? Open it again (may not make it current but to the extent they can use 140000 by Sep 30 2008).
As most 485 applications will notbe processed for another 6-9 months (among Jun-Aug filers), dates will move forward (may become current as well) and whoever has their 485, name check processed will get their GC besides all pending at CP.
They definitely do not have 140000 processed, name-check-completed 485 applications at hand. Hence dates will move.

I have created a letter template (linked below), I have a couple questions that I have put in the comments so you guys can provide some input.
I am going to create another template that you can use to fill in your name and other related information (naidu2543 brought up a good point and I am somewhat skeptical on adding the case number. Admins, any input?). I think we should all have hand-written signature (not typed) in that letter.
I am going to provide a fax number and email address, where each one of you can send the signed sheet.
I think there should be a benchmark for the signature, before we can send it out. From the polls, I see 69 people said that they would support the initiative, I think its reasonable to expect at least 65 people will send their signatures, before we can send the letter out.

When my lawyer applied for my H1B extension she forgot to apply for my wife's H4 extension (Form I 539). Now after about year and half when we are preparing to file for our 485 status adjustment we she found out that she forgot to apply for that. So she is now filing the Form I 539 with an explaination. So that means my wife has been out of status for almost more than a year now unknowingly. How much of a chance does she have to have her form I 539 approved now? Any response would be very much appreciated.

It is very likely that I-539 will be approved without new I-94 and she will be asked to get new visa stamp and re-entry in US.

For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.
For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.
Now the only way forward will be to lobby with IV for a legislative fix. Apart from that there is just no option, the sooner people realise that and help IV with advocacy, the better results we will get.

yes ..it is erratic ..but once they figure out the problems, I think people will get cards faster. I wonder if everyone opens a service request then what effect will that have (I am sure customer service people don't like that and maybe the service centers will start working faster ..).

Out of 800,000 visa pending is it reasonable to say that a majority of the cases (maybe 400,000?) are cases with PD >=2005?? If so the number of pending cases with earlier PD dates (2001 to 2005) will be less. If you break this down by year, the number of pending cases by year does not seem much.. If they process by PD they should clear older cases like 2001 -2003 or even 2004 by end of 2008??

It is just not enough to add a new member to IV. In my opinion, we also need the new member to be proud of associating himself/herself with IV.
Here is what every new member needs to be made aware of-
- What IV has achieved in the last year of existence?
(Manager's amendment, media interviews including the Reuters article plus the last minute attempts in the lame-duck session)
- IV is the **only** grass-roots organization in the US working towards issues of Skilled Legal Immigration. The affected people in retrogression runs close to a million.
The thing I am driving at is that new members join and do not persist with IV because they have not been made aware of what IV is and what it has achieved.
It is not about IV core members alone, the issues at hand are affecting YOU!!!!

I am transfering my H1B to a new employer. My wife is on a H4 visa (Current Visa valid till 2008), can I transfer that without attorney? Please help. Thanks in advance .
I changed my job in Sept of 2005. At the time of job change, it did not even occur to me that H4 needs to be changed (still had not till I read your post). Mind you that my wife's H4 was valid till June 2007. We went to India in Nov. 2005 and got our visa stamped at the Chennai consulate without any problem.
But I think you should really consult a lawyer. It might very well have been an oversight on everyone's part.
