    A special thanks to the person who was pulling the cart with 2 packs of water bottles all along the Rally and distributing water to all the people who were walking in the Rallly. I tried moving that cart and found that it was TOO Heavy and decided to work on some other volunteering effort. But you did it. Thanks!

    Same is the case when i try to view those two threads from office.From home i am able to view thouhg.
    The reason you cannot see from work is because of the privacy settings of your browser in IE. Set you browser privacy setting to low to accept all cookies and also in your security settings set add IV to the trusted sites.

    Do this and you are set to spend all the free time at work browsing IV and waiting for your approval.... good luck :)

    EB3I dates never really crossed 2001 after the JUL 07 drama which screwed all EB3 in my opinion.

    1) USCIS never looked at those cases which got ported out. So if they try to process cases in 2002 they might end up finding lesser cases needing approval than they actually counted, could be bcoz of porting or people who gave up and left the country. USCIS is auto porting the date if you have old labor and i140, I know few friends who got GC like that.

    2) At this pace EB2 will be current by mid next year, once it is processing time for 485 is at least 4 months which will fall into 2012, so the same huge number of spill will come to EB3 ROW. If the spill over is too much USCIS may consider spilling it to worst retrogressed countries.
    -ve aspect: If USCIS starts doing quarterly spill over this may not happen. So as per my logic USCIS will start doing quarterly spill soon.

    3) The as&***s who decided to change the spill to vertical might get bitten by a mad donkey or a dog and might change it back to the old model. I don't see any &&)) why all the spill has to go vertically from 2007, bcoz we irritated USICS or DOS by kissing their weak spots.

    4) As per my Karma or belief model whatever IV does, hurts EB3 more. I don't think any admin fix will fix the vertical spill or recapture.

    Good luck EB3 i guys and try to keep ur frustration levels to LOW.

    Thanks for the advice but your points have too much of optimism. Once Eb2-I reaches July-07, depending on how many months they open it up, we'll see a flood of EB2 applications again. And no one with sane mind is going to file EB3, we'll only see EB2 in most cases. Also everyone whoz waiting to file 485 now have got enough US experience to be eligible for EB2. I doubt, even with spillover, if EB2-I will become current even by 2014.

    EB2 are more skilled by definition than EB3, and hence the priority for EB2. When we all applied under EB3 (or erred by attorneys), we knowingly filed under EB3. Simple.

    Solution: 1) Wait 2) Port over to EB2 if possible 3) Just don't care, live your life in peace.

    I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,

    For 2nd Case should we file by mail, providing certain reason with the application?
    I personally know someone who got BPC labor approved in Eb3, then applied for Eb2 for same position , only difference was his first company was bought by another company and he applied Perm with 2nd company.

    Hi mps

    I am in the same situation. I efiled on 05/14 and sent docs on 05/19. Got FP notice for wife only - that came almost 10 days back. No FP notice for me...My PD is same as urs.. not sure why did they not send FP notice for primary applicant?

    Anyone else experienced this? Primary applicant not getting fingerprint notice after EAD e-file?

    Did anyone get efiled EAD approval without fingerprints?

    I called them this morning (I had other commitments earlier).
    It was good to hear that they are now very aware of these bills.
    Nearly all used the ploy "Where are you from?", to screen out those who are not from their district, but politely noted the call in their logs.
    It was also good to be able to say that I had already spoken with my Congressman on the subject (because that's where they expect you to go first).
    I've spoken with a lot of law maker's aids, and this ("where are you from?") is a ploy that is typically used when they have a high volume of calls. I would take that as a good sign.

    My wife's LC was filed through the old process. We also did the PERM for her and were able to port the old PD BUT it took almost a year and the lawyer told us he had to ask his 'congressional contact' for help.

    PERM may be an option for people in BEC - but not a sure shot one. The whole process takes ~6 months (including advertisements) and you/your company need to shell out $$$.

    I empathize with you - but this is life. I had a PD of Oct '03 - but got sick of my job and changed - so now have a PD of Dec '05. Didn't make a difference as both became current in the July VB.

    All of us come here for different reasons - many like me come for career opportunities. When GC/visa issues become a barrier for your career, it's time to rethink - when at the same time the opportunities in your country are much better. In the grand scheme of things, it's still not clear how important a GC is - don't get me wrong it really really helps - but if you are unlucky - then you need to evaluate the opportunity cost.

    Just got the mail Card production ordered(myself, spouse , dependent).

    Raised SR on 2nd May Got RFE on 3rd , received the RFE(Employement Verification) on 8th.
    replied the RFE , USCIS received on 12th.
    EB2 PD June 5th 2006

    Hi Pps123,
    Did you change the job? They sent the REF letter to you or your attorney? I raised SR on May 6th, and received an email on May13th saying that a RFE letter was sent out. Anxious to know what the RFE is.

    Hi,

    I am planning to start a new petition in EB2 and use my EB3 2003 PD.
    What I gather from here is that the EB2 PERM has almost 100% chance of getting audited due to the current economy.
    I am planning the EB2 with a different employer.
    I have the following questions:
    1) Since I am going with a different employer can I use a different ODot code than what was used when filing my EB3 labor in RIR? ( I am guessing the codes differ slightly from the old labor certification days anyways)
    2) What would happen if by bad luck my new PERM gets denied? Will my old EB3 petition continue to be valid?

    Any advise is greatly appreciated.

    If I can ask a few dumb questions:) (I might have overlooked this but these details, but this thread is huge now). When is the hearing? Who is conducting is? Is IV core involved?

    How can other members here help apart from posting to this thread and $ contributions?

    It was not a hearing, just a meeting with some of the people I worked with over the past year on the stimulus issue.

    Anyway, I went to the meeting and presented the issues raised by people here and emphasized that the first priority is recapture. Of course I raised the other issues as well, presenting the argument that America will lose its competitive edge if its highly skilled immigrants return to their home countries or other more welcoming countries like Canada, the UK, and Australia.

    One person at the meeting was skeptical that many people have been waiting more than 10 years, saying that she has never come across anyone waiting more than 6 years and that these must be special cases where the people were doing something wrong. Anyway, I presented the stories people sent me, but when I raised the issue of granting a fast track to people waiting for more than 10 years, she said that there must be a good reason for it. They need to look at each person on a case by case basis and that a fast track would not be the proper way to resolve these issues. There was a lot of resistance from this person on several issues with the only wholehearted agreement on the issue of getting visas stamped in the US.

    In short, I didn't get a sense that much would come of the meeting, but at least I had a chance to present the issues and I was given an assurance that they would be looked into further and discussed at some upcoming meetings. Finally, I said that the best way for them to understand the issues faced by immigrants is to be in contact with immigrants. I also suggested they join the IV discussions to get first hand accounts.

    One recommendation they had was than anyone who has been waiting for an unreasonable time for their applications to be processed should contact their congressman/congresswoman with information about their specific cases.

    Yes i have been a member since 2006 and yes i dont know much about advocacy and lobbying, but what i do know is that advocacy and lobbying is possible only if you have an organization behind you and in this case EB3 does not believe that the organization named IV is behind them.

    Not probabaly but 100 % confirmed that i have never been a donor. Now my questions is why do big companies in USA donate to any party. They do that because they believe that when that party come to power the goverment will be positive towards that specific business. Now what part of the example is not clear to you. EB3 do not donate to IV because they do not believe IV supports EB3 cause. Sure IV says that it is for all EB but the concerns of EB3 get trodden under the general good of EB Community (Read that as EB2)

    Of course i browse other so called chats and forum because IV is not the sole representative of EB community and in case of EB3 it was never a representative. How swollen is your head with pompous self importance to think that you make the only difference to immigration community.

    It is easy to dismiss what i say as Mob mentality because that another defence mechanism which you use unknowingly where you believe that you alone know what is best for EB community. That is kind of a delusion which you will come out of soon enough

    Yes people can chat and argue all they want on forums because that is what a forum is and yes 99% of people on public forums know nothing about advocacy, but they know about their issues and they do know that whatever advocacy is being done it is not helping them.

    Strange indeed !!

    Dude, two words for you - sue IV.
    If you are so sure that IV is taking your monies and screwing you, feel free to sue IV.
    In this country, anybody can sue anybody over anything!

    Is that rite? 2 wks after the case is assigned to an officer approvals r coming thru? Is that the trend?

    Going by the trend...your lucky day may be tomorrow...Aug 6th...2 weeks from the date your case was assigned..

    Hundreds of members visit this website every day. I am just really surprised that we are having trouble getting people to participate in Advocacy Days and raising $50,000. It seems like a no-brainer to me to participate in whatever way possible.

    There have been around 250 contributions so far. Some members have contributed a few hundred dollars each, with a couple of members contributing $500+ each, and some have pledged $100 for every $2500 or $5000 raised, just to help try and reach the target. They wouldn't have had to put in so much if everyone else chipped in.

    I am really curious to know why you are not getting more involved and at least contributing financially to this effort if you cannot attend the Advocacy days. You are the beneficiary. What is holding you back from trying to do something tangible to help yourself, your family and your friends? Are you seriously going to tell me that it's not even worth $50 to you?

    This is the best shot we are going to have in the next two years.

    I am not doing this for IV. I'm doing this for myself, my brother and my friends stuck in the green card mess.

    I don't think ppl understand how painful the wait in BEC's has been.

    I am really apalled by the ppl in this thread who are saying don't complain about BEC. Their reaction can be summarized as follows:
    "We are sorry you got have been getting screwed by BEC for 3-5 years but please be happy for those of us who started in PERM in 2005 and have been moaning about retrogression"

    Oh Yeah??

    So why didn't we accept the current retrogression as "injustice and screwed up process of USCIS" and just sat tight? Why did IV get started? Why threadful of messages moaning in agony over the retrogression? What warranted those threads, and for that matter, IV then?
