    DOS has alloted most unused visa # into EB2 category this year, and EB3 was stuck due to no additional unused EB1 visas.

    Visa Bulletin mentioned they did this in according to the requirements of Section 202(a)(5) of the Immigration and Nationality Act. But actually this might be a misunderstanding of Section 202(a)(5) and Section 203(b) - There is NO words in the act on how to allot unused visa # to differnt categories. Even the country limit and category limit would not apply if there are unused visas #. The allotment Mr. Charles Oppenheimer did horizontal spillover caused longer and more backlogs of EB3.

    Congress has a concern on the backlogs and Bush's administration promised to reduce backlogs as much as they can. If Immigration and Nationality Act allows the government to spillover the unused visa # to EB2 & EB3, and a more humane and fair system should take care of early priority date first and do whatever the government has promised, should we ask Mr. Charles Oppenheimer to think about alloting some unused visas to EB3 so it can move forword a little bit?

    That is not true...If you look at the Visa Bullettin, it says

    First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.

    Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any umbers not required by first preference.

    Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "Other Workers".


    Based on the above EB1 spills over to EB2 first.....Eb3 gets unused EB2.
    EB3 gets EB1 only if it is not used by EB1.

    I'm EB3-I with Oct 2003 PD and I understand your frustration. There is hope only if a legislation change happens. Based on my calculation, there are about 50K to 60K EB3-I pending before me.

    Can we do a blood drive next as protest! seriously. Donate blood as protest and for media attention.
    I totally support the blood donation idea. I am pretty sure, a blood donation drive would be front page news on American Red Cross web site also. It should send out a message that the GC is so important to us.

    The actual collection of blood hopefully will be fully carried out by the American Red Cross.

    My friend: We are one people. We all came to the US with similar dreams. There are many who came before us and are patiently waiting their turn. The issue is not yours or mine, its OURS. It is our duty to fight this injustice and provide equal access to all. Learn a lesson from the jewish community. They pretty much run this country.

I am sure that in India incarceration is very low because lot of criminals don't go to prison, instead they rise in politics like your leaders Advani, Modi , Laloo etc. (who would have languished in a prison in any other civilized country) and become prime-minister material. :D :D

    Or are you planning to pratice some white-collar crime/fraud here after getting the coveted GC - like starting a "consulting company" to import indentured servants at dirt cheap prices? :D :D

    i guess some of the folks who are in the same GC boat do not approve of a few getting into citizenship while the rest are left behind.
    This is fully understandable.
    All what we are aiming for, finally, is citizenship.
    All what a few red dotted folks here are talking about is to set a fair timeline for it.

    Say if one gets the GC after 4 yrs of application, s/he will get a citizenship roughly 10 yrs from that start. What is wrong if someone who is waiting in queue for 10 years can finally apply for citizenship?

    We need to find a plan to propose that will speed up the GC process as well as deliver citizenship after a foreseeable period of time.
    There is no discrimination here.
    Please feel free to reason out instead of pouring in red dots.

    Folks,
    I got a call from the Ombudsman Office today morning was told that my case is in "transit". When is asked her what it means she told it is going to be reviewed by an IO. I got the similar response to my SR that "your case is pending adjudication by IO" so don't know what to make out of it in the sense that its been removed from the shelf and sitting in some pile and IO will get to it when he/she can?

    Did any one get their GC approved after their case was in transit? How long did it take?

    Do you seriously think any of these people will become plantiff and risk their greencard applcation? Because by becoming plantiff their application will be scrutinzed and further delayed.

    We should all feel proud that many co-sponsors are a result of efforts of IV and its members.When members ask proof of success, this is one of them.
    Well done IV for the work so far - but we have to continue this push. Any idea on which other members we should call.

    Note: I spoke with a few members to encourage them to call, there seems some confusion in their understanding of which congressmen we should call first. Calling the current co-sponsors may not be necessary but calling other members might still result in adding more co-sponsors (if we are able to convince them).

    Friends, October bulletin is out and we are again seeing the retrogession. So forget about the talk that all dates will become current - it wont happen unless there is a change in law and past visa numbers are recaptured. This bill is our biggest and only hope until for atleast another year. Lets do our part and hope for the best (believe me - all it takes is less than an hour of your time).

    I was a July 2nd filer and my cheque got encashed on Oct 4th 2007:). It feels good :)and from the receipt number on back of my cheque my application is now in texas. All the best to all of you.

    I called one of these #,s and said I wanted to talk to some one in charge of immigration. The call got transferred to some other person, and the person asked for my last name and told me that he would contact uscis and let me know the status.

    I think we are fighting the wrong fight. I do recognize the whole EB system is unfair and in particular to I/C/M/P.
    The letter campaign is a great initiative, but I am not sure if we are focusing on the right problem. By saying that the new "interpretation of the spillover" is cruel to EB3 I/C/M/P is plain wrong. Both old and new interpretations were unfair to EB3 I/C/M/P.

    Old interpretation resulted in good forward movement to EB3 ROW while EB2 crawls.
    New interpretation results in good forward movement to EB2 while EB3 crawls.

    How does EB3 ICMP benefit from both the interpretations?

    EB3 is clogged because of the 245i cases. Unless we focus on the exact problem no amount of letters to lawmakers will not yield any result.

    Writing letters to lawmakers is not going to provide any impact for this year Here is my reason it takes 3-5 weeks for the lawmakers to get the letters in DC because of special security screening requirements. By the time they receive the letters the Congress would pretty much be done with their term. The best option would be to meet with the lawmakers in their local office or in DC and appraise them of the long wait.

    Please do understand that one of the reason USCIS changed their interpretation is because many folks with Ph D's and MS from ICMP where waiting for years to get GC"s and USCIS/DOS looked stupid in explaining the reason for the long wait for such folks. Even in the "visa wastage" hearing in the House immigration committee (on Apr 30) the DOS/USCIS was having trouble explaining the long wait times. One of the witness in the hearing was a PhD from China and had been waiting for years for his GC.

    Come on folks. EB2 forward movement is good for EB3's, because EB2 will soon become current and the spillovers will be soon coming to EB3 after EB3 ROW is current. I am anticipating DOS will turn EB2 current in the second half of the year and this will ensure all the spillovers will flow into EB3's because EB2's with PD mid-2007 to now will not be able to clear the NC 180 day barrier. Cheer up folks and let us focus on the real problem getting more number of visa's through recapture.

    If you feel strongly about the cause you should meet with your lawmakers office and address the issue. Letter campaign in not going to yield any short term impact. Please take the time to meet with your lawmakers

    why are we giving so much importance to Ron. If he is so concerned about this issue why can't he take up this issue with AILA? He is a member of AILA.

    During the discussions on 1485 filing provisions we there were questions related to EB2, EB3 backlog numbers post 2007 july + Based on the recent information we got on pending numbers + our discussion on if EB2 will get current this year helps us understand how the last quarter will behave. This analysis is not official and is our own interpretation based on information we know. We do not wish to seek out specific information on visa bulletins. It has not been IV policy. VBkris has been involved with IV statistical analysis of data and has been in meetings with officials. He has come up with an explanation to this news and how it may play out for the last quarter. His interpretation makes sense to me and I have asked him to post on the forum.

    After seeing the May bullettin, it seems what the US is actually giving us is either a A kick in the back or a slap on the face?

    May be we can create a poll for that send the results to the president.

    Well it is their country. We are serving through our volition.
    We have an expectation, but in a free market it is demand and supply.
    i am Not trying to be negative - just a reality check on where we stand and how we can approach.

    It is a fact that immigration from Asia shot up at the turn of the millennium. This may look disproportionate to proponents of diversity.

    Now 1/6th of the world population comes from one country. But the quota for Iceland and India remains the same.
    Consequently many like us cannot: change employers, give up opportunities (lure of which we came here for) and wait for the same outcome that others achieve much faster, simply because they were born somewhere else or their employers & lawyer decided their immigration category. So much for free country and meritocracy.
    i believe our main point should be a level playing field and transparent
    system so that expectations are clear.
    For those of us who have suffered due to lack of clarity, for all fairness, must lobby for a chance to parity after multiple (say 10) years of serving LEGALLY.

    Based on your calculations , Experts, please let us know what to expect, if 12000 GC are released for EB2. Where will the cutoff come and stop..

    Whether USCIS can find out or not depends on their IT systems.

    I am 80% sure that you need to be present in US when you are applying for 485. Better safe than sorry. What you can do is - prepare all the documents and file it as soon as step in to this country.

    That's been my understanding all along. Applications are approved per the Notice Date, provided the applicant's PD is current. But I know, we've all seen exceptions to that rule. I guess this is more relevant in your case since you're current, but I'm not, so it doesn't really matter too much anyway. I just don't want any RFEs.

    I think the program scoops up all the applications on that date and check whether the dates are current, pre adjudicated and available visa numbers. then it may move to the case officer or approval or "automagically" approves the Green card!!!!:D
