    05/17/2007: USCIS Terminates 05/18/2007 PPS for Labor Certification Substitution I-140 Petitions

    USCIS announced today that beginning on Friday, May 18, 2007, it will terminate Premium Processing Service for Form I-140 petitions that request labor certification substitution. USCIS anticipates a substantial increase in the number of petitioning employers that will file Form I-140 petitions requesting Premium Processing Service and seeking labor certification substitution prior to July 16, 2007. The volume of such petitions filed requesting Premium Process Service is expected to exceed USCIS� capacity to provide the Premium Process Service according to the program guidelines.     Well, bad news for those looking for labor substitution. But I believe you can still file I-140 with premium processing if you have your own labor.

    I bought tickets from British airways last week (called them to find out they were non refundable). Wish this post had been posted earlier.........I agree with the author the questions they ask for a TV are hilarious. Maybe I will have some wonderful experiences worthy of a post. :)


    Well good luck with your visa. Don't forget you might have to go for finger printing too. I was one of the lucky few who applied in November, so no need for FP. Here's my experience on Air India from NY to India via London.

    After spending couple of anxious days waiting for the green light from Mr. Gordon Brown, we finally got our visas. The little kid in me was jumping up and down with joy and at the same time the mature man in me was saying "What's the excitement about? It is only a stupid visa and that too transit!� Anyway we packed our bags and took Air India into London. The NY-LHR trip was uneventful except that the entertainment system was not working for most of the passengers including us. Needless to say my kids were totally disappointed. I was not. Maybe I had suspected things like this are a routine on Air India. Flight crew was courteous and helpful (against my expectations). Food was good (I admit, I enjoy airline food).
    After we landed, the passengers were asked to exit the aircraft along with their carry bags. Many of us were puzzled as some of us wanted to catch up with our sleep. Reluctantly everyone had to leave the aircraft. Someone was saying there is another aircraft waiting to take us to India. Makes sense, that is why they asked us to take our cabin bags too. After we entered the building we were asked to take the left door. Behind the right door was a waiting room. A couple of turns led us into a corridor which was probably about 1/2 mile long. At the end of the corridor there was security check. Again I was puzzled, why security check now, we are already in a secure area. The transit visa form with those 111 questions suddenly came in front of my eyes. Nothing less than a new complete security check will satisfy these neurotic people. It was time to go thru the exercise again. Took off the shoes, wallet, coins, Jacket, belt, pants .... when I was gently reminder by the security guard that it was not required today. When my turn came to send the items thru the machine, I complained about the fact that I have to put my jacket in a bin that was probably used earlier to keep someone�s shoes. (And you know where the shoes go. And sometimes when it gets wet, it is not necessarily because of water. The thought itself was so revolting that I decided to get my jacket dry-cleaned after I reached India). Needless to say my protest landed on deaf ears. After going thru the security gate, it was time to go thru the final check. I assumed the flying eagle's position and was quickly scanned and cleared. Beyond the security point was the shopping and restaurant area. I was bit thirsty but could not force myself to spend on a bottle of water. I was so put off by this whole experience that I did not want to spend a single cent here. We looked at the monitor to find our gate and quickly proceeded towards it. Again we walked for about half a mile or so. Things looked familiar, but I quickly brushed off the idea. At the gate we presented our credentials and were admitted into the waiting area. Then again I got a sense of d�j� vu. I soon realized it was the same freaking waiting room that I saw earlier and the same aircraft was waiting for us. We needlessly walked for more than a mile, subjected ourselves thru security check. All this for what?
    After waiting for an hour we were allowed to go into the aircraft to the same seats and surrounded by the same little pieces of garbage still on the floor. I congratulated myself for not buying the water bottle and looked out of the window to say final goodbye to London. Never again! Never.

    No doubt Emirates is the one of the best airline One problem flying through middle-east is that you may be taken in for secondary inspection. Happened with my friend twice when he flew Kuwait. Never happened with other Airlines. My experience flying KLM,Lufthansa, Swiss is been the best.

    very interesting thread ..it is more interesting than the other famous thread "how to get your maid to USA" ..no wonder some senior core members are disappointed because no one cares about other threads which talk about recapture and other campaigns.
    the only point about renting the house is that it has many pitfalls too ...one of my friends tried that and he is a full time businessman ...problem is many people stop paying rent after 4-5 months ...it happened in his case plus the tenant painted the house in red and green colors.. In US it is not very easy to evict the tenant ..you have to go to court etc etc (so it is sort of full time job).
    on top of it ..how do you make sure that 3-4 families are not staying in the house ...i.e. u rent it to 1 person and that person reduces his rent by renting it to 2-3 families ,... these few points are the problems that you face by renting


    Cant we put all these conditions in the contract? No modification to the house..only one family allowed..unless you want to rent it to bachelors and then charge whatever amount from each person and limit their number in the house..
    Contracting agencies do not assure if they will put the house on rent. they say they will find someone.. and how long it takes, they are not sure..

    Ask them to connect you to the head/Senior executive. I did the same thing with my local cable+phone and was connected to a the head of their customer Service. That person connected me to more senior marketing person. That marketing person called me and emailed me to discuss. The company had no idea about Vonage plan and seemed unprepared to have a strategy to stop the exodus of its customers to Vonage.

    All of you can do the same. When more people do it, it will generate market demand and customer demand that money hungry capitalist companies cannot ignore. If you do not do it, then one company will have monopoly over this market.

    I just talked to one of teleblend rep (live chat on their website, very easy to do and I can do this during lunch time from office). The guy said they are working on something but was not providing any time line or details. I told him to hurryup else I will switch. Looks like we need more teleblend customers contact them to get this done faster. Guess they are waiting to see what effect or how many customers actually switch to vonage. Teleblend must offer $20 world plan in order to stay afloat in competition. I say this as they now offers $15 unlimited us-canada Vs. vonage $25 unlimited us-canada plan so far.

    I have question, really do we need to submit
    Form I-134 Affidavit of Support (notarized) or I-864 for employment based dependents AOS.

    Why some attorney are advising and some are not?
    If we follow 485 instructions we do not need to submit.

    Are there any body submitted with out affidavit of support to thier dependent's AOS?

    It seems the popular perception is that this is an Indian effort.
    We need to correct it.

    It seems some of the members who interviewed with the media got carried away with "Gandhigiri" and all things Indian. It sounds ironic, we are craving attention from Indian media while trying to become Permanent residents of USA.
    I don't think we should read too much into it. IV is obviously not an all Indian forum but the entire idea started with inspiration from an Indian movie and almost everyone that reporters have spoken to is an Indian. So it is easy to take away that impression.

    It's not always possible to cram every fact and our every grievance in a 500 word report that needs to be understood by readers who might have not even heard the term green-card.

    Type in congressman your city name in google or yahoo search. It will give you various names for your senator and congressmen. Call them and give them your name FN LN, DOB, Alien number and fedex / delivery tracking mnumber. They will call you back with relevant information.

Seems like USCIS is either not following the First in First out (FIFO) process for sure or the figures are misleading.

    My current situation is that my wife and I applied for 485 separately.
    my wife's PD is 2007 ( 485 applied in Aug 2007 )
    I applied for 485 in Oct 2007, Since my PD is 2003 and is current as of now ( my 140 is pending ), I talked with our companys lawyer on what options do I have with regards to my wife's 485.

    My lawyer suggested 2 options.

    1. File 485 again for my wife as a spouse derivative. As per lawyer, this is very common and has experienced with these kind of situations.

    2. Instead of filing a second 485 for my wife, just write a request letter to move her pending 485 to my 485 as a derivative. If this porting is successful, she cannot move back to her own 485.

    I know some of us have gone with option#(1), but since option(2) involves very less paper work, did any of you have used this option so far?

    I am confused as to which one to choose. My lawyer spelled diplomatic when asked about which option is better/safer:-)

    L1 Blanket visa, from the a very reputed company, Jan 16th interview, visa was approved (i.e. no 221g), no information from Consulate, no idea as to what is delaying the stamping.

    Folks,
    Today at 2:03 PM EST I received the coveted CPO mail for my wife. I was approved on Sept 3rd and was the primary and I have not yet received the CPO as there is Biometrics issue, my wife had the same issue but the vagaries of USCIS which is worse than Indian monsoon...

    I wish Caliguy, Fatjoe, Apb and many others who are at or older than my PD get their approval soon. If I can be of assistance in any way to you guys please let me know....My wife her case was separated from me and I was worried that it fell thru the cracks..but my persistence with all the channels especially congressional and POJ I guessed did it.

    Not that you guys are leaving any stone unturned but just keep trying...

    She was at initial review stage till Oct 2nd and not preadjudicated and separated from primary case and bingo on 5th she jumped to CPO...

    You really never know...

    Take care and I'll still be visiting IV and commenting and helping out..

    Hello every one,
    I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
    Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
    What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
    Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
    1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
    2. If they have earned full 40 points in Social Security
    3. If they have paid the tax continuously for 10 years
    4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
    and
    5. If they do not have any criminal records in these 10 years.

    Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
    Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

    Any person holding a B1 or B1/B2 visa may be eligible to perform H-1B work in the United States as long as they fulfill the following criteria:

    Plan to perform H-1B-caliber work or training
    Will be paid only by their foreign employer, except reimbursement of incidental travel costs such as housing and per diem. The employee must not receive any salary from a U.S. source.
    The task can be accomplished in a short period of time.
    These travelers would be admitted as B1 visitors, and may only stay in the U.S. for the time allotted by the Department of Homeland Security upon entry.

    Like any other B1/B2 applicant, travelers must still show strong professional, familial and financial or other ties, which indicate a strong inducement to return to the country of origin or another country other than the United States.

    Consulate General Mumbai is prepared to issue B1/B2 visas to qualified applicants for this purpose. These visas may also be used for tourism. Current holders of B1/B2 visas may already use this provision without seeking another visa.

    When seeking a visa for this purpose, please clearly explain this in the applicant’s BEP cover letter.

    The Customs and Border Patrol agents at Ports of Entry are aware of this provision. If asked at the border, applicants are advised to explain completely their purpose of travel and that they will not be paid from sources based in the United States. Travelers are encouraged to carry a letter from their host company and Indian employer listing the traveler’s duties, length of stay and remuneration plans.



    Looks like, "The B1 in lieu of an H1B" can work in client location if approved.
