If its mailed out today, then you are ok. Its the POSTMARKED date that is seen. So even if it reaches there in July, as long as it went OUT today, they will have to accept it under June's batch of applications coz it is postmarked in June (june 29).

I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.
We can definitely question them on how their understanding changed on visa spill over distribution.

Delays in Visa Issuance Resulting from the Department of State�s New Directive on Nonimmigrant Visa Issuance
The U.S. Department of State (DOS) instructed consular posts that approvals of H, L, O, P and Q visa petitions must be verified through the Petition Information Management Service (PIMS) before a nonimmigrant visa can be issued. PIMS is an electronic report generated by DOS�s Kentucky Consular Center that collects nonimmigrant visa petition approval information from USCIS. PIMS contains data on initial petition approvals and on L blanket petitions that were approved in 2004 or later. PIMS does not contain information on approvals of extension of stay or changes of status petitions.
Consular officers adjudicating visa applications must consult PIMS to verify the approval of the underlying nonimmigrant visa petition. Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.
Correct me if I am wrong but to my knowledge quaterly spill overs if any would be in the last month of the quater which should be in Dec 2009

Everyone knows that increasing green card numbers will be best solution. In that also if we ask too much we may not get anything. Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.
But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

If you entered on AP and your I485 is pending, you cannot fell out-of-status as you are being considered in "Adjustment of status" status. This is somehow a special kind of a status. The only problem one may have is if the I-485 is denied for any reason. At that point you fell out of status. That's the reason many choose to enter on h1 instead AP. Then, even if I485 is denied, a person who entered on H1 is still in H1 legal status. Hence, it is generally advisable to enter and maintain an non-immigrant status while i485 is pending.

If USCIS recaptures lost visas (estimated to be in the range 300k-600k), all of us will be current. IV should start a drive to push for the recapture ....even if it is partial, it would help everybody in a big way.

If your PD is current for the July bulletin, then your application has to reach on July 2nd which is a Monday.
If your application was to reach on Saturday, June 30, and if the mail room guy is working overtime (assuming that the hell has frozen over), then your application will be sent back soon enough. Of course, the mail room guy is not going to open it on the same day; he/she is only going to stamp the date. And then when they really open it (2, 3, 4 weeks from now), they will send it back to you.
If your application was to reach on Sunday, July 1st, and if the mail room guy is working overtime (assuming that the hell has frozen over AGAIN), then your application will be accepted.
But if either of the two things above happen, I am not sure that GC is going to be my priority since hell would have frozen over...and I believe that's where we currently are stuck! :-)
So just take a chill pill, guys, your lawyer should know that the application should reach between Monday, July 2nd and Tuesday, July 31st. The end date can change once the August bulletin comes out.

Even though I'm EB2 and still waiting for GC, I oppose this. This is not fair.
