Hello,
The frustration that I see here is understandable, but just by being frustrated or by posting here, things do not change.
We are the change that we have been waiting for.
There are many things that IV core is working on (we see the outcomes like pending I-485 stats, notes of explanations on visa bulletins, but fail to recognize the efforts required to reach these key milestones on bringing transparency and fairness to I-140/I-485 process).
But to make IV (or any organization/community) effective, money is critical. What IV needs is not big (you can contribute as low as 25 USD per month - less than the cost of daily coffee - regular, not the fancy lattes!).
IV is nothing more than our collective will to change our situation. And the change starts from me as an individual. What I've come to realize that such change doesn't come by asking others to do something for me. It starts with me doing something, either providing my time/effort/money to the cause that I believe in.
In case of IV, some of us choose to contribute money, some choose to volunteer (hats off to them!), others choose to contribute time, still others do the legwork ... to each his own! Pick your preferred way and start... the success is not guaranteed, but if we don't start, the failure is guaranteed!

Ok, clearly you did not read what I wrote or you did not understand it. Here is what I wrote..
"Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.". Some one left me a red saying "not all consultants from sleazy bodyshopping companies are incapable." I agree and I never said that. If I came across that way then I apologize.
Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.

My point to say all companies lie/manipulate things to certain extent..desi consultants atleast dont deprive lives like other BIG companies where shareholders are kept in dark until they realize that company is no more worth anything.
Comparing one wrong doing with another does not justify as an argument. It is actually a logical fallacy. In other words, 2 wrongs do not make a right. Try doing that in the court of law.
Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..
Malpractices are criminal (if law is violated) but a corporation cannot be tried criminally because it cannot go to jail.:)
You may have noted that I did not bring up morality even though I wanted to because everyone has a different measuring stick for it.
however if theres a loop hole and people want to chance it its upto them. They will be appropriately denied if they are caught, However its not like they are killing anybody.
I totally agree with that. Also, I don't think they will be denied because they did not do anything wrong. System provides them with an option for doing so.
Finally what do you think when even govt is planning to make illegals legals ..its respecting peoples wishes against legal things(ofcourse they get benifitted)Humanity/compassion is number one..rules are for our well being ..they are not hard and fast.

What are you talking? which part of the world do you belong? Obama is the democratic candidat for 2008 Presidential Elections Its conformed.He is not still fighting and also he how can you justify that he is a weak person? do you know he was no where in the picture and no one expected he will won the nomination when the Democratic Primary was begun..now he is the democratic PRESIDENTIAL NOMINEE..by now you should have undestand how powerful he is.
Weak or strong, either he (or Sen. McCain) will be president, and not king. They may have a strong influence in the Congress, but they can't boss it around. Specially since a minority in congress (be it Democrat or Republican) has its own way of stalling bills they don't like. I hope next president brings sanity back to the Washington.

Just in, Obama Administration wants to change law allowing employee to sue past employers and seek compensation. Current laws allows employee to sue for events up to 24 months in the past. This will change and suing employer is going to be a lot more easier. Bring it on baby, this time employees will be millionaires by suing body-shoppers. I am no longer going waste my money to buy lottery ticket :p

No one knows for sure what the final rule is likely to be. Chances are anyone who doesn't have approved petition may be rejected once substitution is cancelled.
People sometimes don't want to believe bad news.. and this is what is going on with some desi employers and immigration lawyers..
but all signs are it's gonna happen and very soon.. maybe March 1st. I myself struggled and decided against someone who offered me in past 1 month.

Then there is no need to worry. FBi check is valid only for a certain period so that is the reason why they would have ordered for other check. Don't Worry you will get your greencard. But when your PD is current open a service request. i did mine when my Pd is current and got my Green card.

Based on this poll, anybody with PD of Jun2002 onwards should consider Porting to EB2.

It won't help, if everyone starts porting, EB-2 queue will face a similar situation. Porting doesn't happen soon either. With delays in I-140 processing, it may be close to 2 years before you could file for a fresh I-485 with a request to port the EB-3 priority date. Note, this is a grey area and doesn't guarantee you the old PD. If the company is willing to foot the bill, go for it or else IMO it is not worth spending your own money.
Legislative or Administrative fix is our best option. We should focus on the recapture bill and other initiatives by IV, contribute and participate in the action items. We, as a community should raise enough money for lobbying etc.,

I got an LUD on 485 when i got AP approved.
Dont even try to rationalise how the f*** those systems are inter connected and how they roll :o
Same with me. I applied for AP and got it approved on Feb9th. On Feb10th, I got soft LUD on mine and my wife's 485. I was hoping thats pre-adjudication, but I have my doubts now. They just probably are checking my 485 at the time of AP approval. :(

Looking at your RD reminds me of a friend of mine who has a I-485 RD of Dec 2004, but he is in EB3. Unfortunately his NameCheck was not clear even in the July 2007 fiasco, the reason he is still not green !
He and his wife recently sold their house and everything else and left their jobs and moved back to India! Enjoying themselves there while their I-485 application papers turn yellow !

Wanted to let those interested know that my 140 EB2 got approved yesterday after RFE.
The RFE was on educational grounds. I have a 5 year integrated Msc in Physics and was -how a degree in Physics is equivalent to computer Science.
My attorney submitted a detailed analysis of all the course and a fresh educational evaluation on the 28th and it got approved on 30th.

Try using onlinesbi.com/gls for money transfers and u can also open NRI account....I have also used to use ICICI before but from past 1 year I am not using any more ICICI bank....If you guys want to open speak with New York Branch Asst Manager Saikrishna, he is so nice, he will helps you like any thing in terms of every thing...I have ever seen such type of friendlyness in any govt organizations.....SBI also gives better rate than any other banks or web sites.....

Not true...
In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.

Here's an anecdote -
This was back in the late 80s, when I was growing up - in Bangalore.
India had just lost the Finals of a well fought [field] hockey match to Pakistan. We were all very disappointed by the loss, but it saddened me further to see a victory procession with waving Pakistani flags in the Muslim parts of the City.
Ofcourse, India is a secular country and more so the United States.. and you can cheer whoever you please..
But, If you chose to become a US Citizen, and US were in a battle with your country of Origin (let's narrow it down to Sports, to keep it less complicated), which country would you side? If I chose to side with my country of origin, it would make me a hypocrite, wouldn't it ?

In your situation, it is better to use EAD to save remaining time in 6 year period of H1. It is wise to use EAD, if you are in initial 6 year period of H1. In case if 485 is denied, you can go back to H1 and enjoy remaining period in 6 years. H1 extension, beyond 6 years is always based on pending immigration applications like LC, 140 and 485. If 485 (final step in GC) is denied, the H1 extension is also invalid. Fortunatly, USCIS do not have highly integrated system to revoke all underlying benefits (H1 Extn or EAD) based on pending immigration application was denied. After denying 485, unless USCIS specifically revoke H1B extension they granted after 6 years or EAD, you may be eligible to legally work with that document till its expiry. However, if they bring more integration to their system, they may deny all subsidary benefits due to denial of 140/485.
