Good evening,
I am currently in the United States and in the process of changing my Q1 into a F1 visa.
My contract with the Q1 visa unexpedently ended in June 2009 and the visa was expiring on the 17th of september 2009.
I sent the file with all the papers to the USCIS before the end of the expiration date and is still in process at this time.
I heard that i can not exceed the period of 180 days after my last day of work with my Q1 Visa.. Is this true ?
I was thinking by the time i filed everything before the end of my Q1 visa, i could stay in the United States until the approval or denial of my F1 visa...
if this is true :
1. Do I have to wait in France for the answer of the USCIS, or my case will be cancelled and I have to start all oveer again in France ?
2. If I do not stay more than 180 days, going back to France and coming back for exemple 1 week after to the US with a tourist visa, am I able to change my status to F-1 ?
3. If i receive an approval answer from USCIS after a few days that I've been back in France, will it be valid ? Can it be sent to me ?
4. Do I have to get a new I-20 from the university if I am starting the process in France, or the one that I have is still valid ?
Could you help me please, beause i am confused...:confused:

I am on H1 & my H1 (& visa stamping) expires in Apr 2009. My wife has H4 stamped on her passport until Apr 2009.
My wife got her H1 approved in 2008 lottery with permit to start work starting October Ist, 2008.
We are planning to take cruise to Bermuda from sep 28-oct 5. I just wanted to know ,
a) will her H4 stamping be expired on October 5, 2008 , as her H1 will become effective?
b) or she can use existing H4 stamping to re-enter into United States.
c) or if someone knows whether she needs a valid visa stamping in accordance with her latest immigration status (h1 in this case on oct 5 , 2008) when returning to US in cruise.

The lawyers did some mixup/goofup and I lost my June 2002 PD. Here is the sequence of events.
Original Labor (Labor1)
PD: June 2002
Category: EB3 (incorrectly filed at that time by lawyers)
State: CA
We didn’t hear about the whereabouts of my labor1 case because it was sent to the Backlog Processing center (all cases after May 2002 were sent)
So the lawyers suggested filing a new labor under PERM.
Second Labor (Labor2)
PD: Oct 2005
Category: EB2
Approved: in December 2005
Second I140
Approved: in December 2005/Early 2006
Received Original Labor Approval in end of Dec 2006
The lawyers decided to combine the 2 cases and file for I-485.
i.e. use the ORIGINAL Labor PD and SECOND Labor EB2.
In April 2007, 485 application was open for “EB2” – “June 2002”.
So the lawyers filed for concurrent I-485 and I-140 for the ORIGINAL EB3 case (they submitted Second Approved EB2 I-140 along with it)
ORIGINAL I-140 was approved in Oct 2007
PLEASE NOTE: the unique situation is that the SECOND I140 was approved before the ORIGINAL I140.
Since April, 2007 - We were told by my company lawyers that the 485 is under process EB2 PD June 2002.
The GC Visa number have been available for EB2 PD June 2002 for a long time now.
But we still hadn’t received our Greencard for a long time and were wondering what is causing this delay.
So after much ado by our lawyers, they agreed to check with USCIS.
Because the Second I140 was approved before the First I1-40, USCIS said that we cannot use old PD
According to our lawyers, Now our current case status is “supposedly” OCT 2005 EB2. So we lost the June 2002 PD.
Is there anyway to recapture the old PD? (with or without refilling I-485)
Any suggestions,help or insight will be greatly appreciated.

Did you apply for an H4 along with H1? You should ask this question to one of the attorneys, this is pretty complicated.

2) The individual must have correspondence from the US government documenting the absurd red tape (a letter explaining the delays in their green card, etc).
Please contact us as soon as possible if you meet these requirements � or know someone else who is - and are willing to speak with the reporter. It would greatly advance IV�s cause to be included in such an article, so please help us.

I am on L2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job?
What is going to be his new status? If it is not L1, then your L2 status is gone as well.

I am a July 07 filer. Recently I sent in EAD renewal application and got it approved within a month. When I saw my EAD card the Sex category on it was F instead of M. Now what are my option. Should I reapply for EAD or continue working on it. I changed my employer last month and am currently working on EAD.

Guys,
I found some new information and it seems that few people who are still waiting may get some clue if not complete idea. Basically I found that when your PD is current the the IO will initiate the FP, Namecheck, IBIS check again when your AOS is in "Final Approval, Visa Available" state. Some IOs would just refresh the FP they have on file and some request another . But namecheck is something that you have to go through again. So if you get stuck in namecheck again, then that could be the reason for the delay since NC takes forever.
Can you please share the source of this info?
Is it a learned experience or from a published source ?
Any info is highly appreciated.
