    When you reach NSC or TSC, you talk to an IO. Who really is an IO? Are they first line of customer service at the centers? They then send requests etc to officers handling your cases?

    I am trying to understand the relationship between the Customer Service agents, IOs and the case workers.

    I have filed I-485 in Aug2007 and am in retrogression. I am currently working for my sponsoring employer on H1 but also have EAD and AP. I have to go to India to address parents health issues and may have to stay there for possibly 6-9 months. I plan on re-entering using AP.
    1) Will my GC application stay active if I am gone for such a long time?
    2) My fingerprinting was done long ago - do I need to be in US when my case is adjudicated and GC approval is sent in the mail?
    3) Since I will lose my current job due to the long absence, will that be an issue at POA since I wont have a current job or a job offer letter to show the IO?

    My friend lost her green card while she was on vacation in China. She got a temporary green card to travel in a week or so which facilitated her entry into US and once she reached here, she just applied for another green card claiming the initial one as lost. There were no issues except the travel delay and the monetary loss.

    Hi all,

    I got married in March 08. My wife is on H1 before marraige and working at Minenapolis but after the marraige she always stayed here(found a diff project) with me in DC. The mistake (i think) we didnt paid much attention the to the update on the address or the maritul status on paystubs and as of now both our paystubs show our older addresses and single status (as we thought we can file a joint return at the year end where we can do all adjustments). Now that my date is current and applying spouse as derivative will this raise any rfe (ofcourse i have the marraige doc)? As such iam not to bothered about the rfe per se as ours is a genuine marraige but iam worried whether these rfe will lead to extreme delays (i have seen cases) and whether anybody encountered this kind of scenario before pl post your experience.

    Appreciate your opinions on this.

    Hi,

    I went to US on B1 and came back to india last week, I would like to apply H1 in the current year. Is there any cooling period to apply H1B once come back from US on B1 or Can I start the H1B process immediately.

    I'm at the annual meeting of the American Immigration Lawyers Association here in Las Vegas. More than 10, 000 lawyers gathered here in Las Vegas to learn about the most recent updates from the Government directly.

    We just finished a session with the Department of Labor. Some of the key news is that more company audits are on the way. In fact, currently there are 200 cases pending in the audit line. They promised more audits as the icert system will become a standard in filing PERM, LCA and Prevailing wage requests.

    Also H2B cases now must prevailing wage requests directly with the Chicago DOL center. There is a slight delay in processing. They are currenlty working on PWD's filed on May 8th or before. Wea ll need to be patient.

    I will keep posting more updates as the day progresses. Next I am off to the USCIS open forum. More exciting news to report soon.

    Date1 = The date your LC was filed (Or I-140 if you are LC exempt case)
    Date2 = The date on Monthly Visa Bulletin for your Country of birth, and
    category

    If Date1 is older than Date2, you are current, otherwise not

    This info might be a little old. But I filed for PERM on Dec 1, 2010 and it got approved on Dec 19th, 2010. So, 18 days. Also, you can find the latest info for PERM approval processing time on www..com

    Hello,

    Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

    You will apply when your number is current on the visa bulletin.
    your interview will be scheduled in the 2011 fiscal yr which starts in october.
    you can adjust the status in the u.s but be careful with this as the backlog can make it a long wait or you can go home or to the country of last foreign residence and get it done the same day.
    any extra questions, send me a private note - i am very familiar with this process.
    in the meantime, start collecting your documents for the interview as instructed in the package you will have received.

    My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

    hi everyone,
    i wondered if someone could help me find answer to the following questions.

    I am a Physician and currently in Residency program which is for 3 years. my residency ends on 30th September 2008 and i have H1b status. I have been offered Fellowship in my desired specialty but it starts on 1st January 2009, therfore there is a gap of 3 months between the end of my current job and beginning of my next job.
    so my questions are:
    1. H1 petition which I will file for my fellowship starting 1st jan 2009 would be an extension of my current H1 or would I have to file a new H1?

    2. suppose I find a job for 3 months gap period at the same institution where I have got my fellowship (keeping in mind that decription of this job would be a little different from what i will be starting from 1st jan 2009), would i have to file for 2 different H1B petitions (one for 3 month period starting 1st oct 2008 and the other for fellowship starting 1 st jan 2009).

    3.also, I was thinking that if I file for H1 approval say in july 2008 for the fellowship starting 1st jan 2009 and get approval by mid september 2008. with the approved petition I go back to India and have a vacation for 3 months and come back to US in late december 2008 on H1B again for Fellowship beginning 1st jan 2009. In this case, what would be my status for the gap period of 3 months that I spent in India?
    also, would I be issued a new SSN when i come back again. also, i have heard rumors that US embassy in Delhi can hassle you to get H1. How true is that?

    Is there any other option someone can suggest?

    Dear Sir/Mam,

    I am presently working in India. My wife is getting an L1 visa approval petition. We need to go to the US consulate for visa stamping.

    My question is that 1) Do I need to resign from my current job to get a L2 visa stamping on my passport? 2) If not required, do I need to carry any form or letter from the company that I am on long leave/vacation to show it to the US consulate officier?

    Please advice.

    You don't need to quit your job nor show any documents on extended leave to get a visa. Since your wife is the primary applicant, you just need to show proof that you both are still under bonafide marriage. Obviously, you will have to quit or take extended leave when you intend to travel to US but nothing to get a visa.

    Hi all,

    I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?

    What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?

    I am confused, its a good offer, and i dont know what to do. pls help..

    Thanks for reading this message. Since you are from mid-west, you are capable of taking your car and drive in the direction of DC. It will take anywhere from 9-15hours. But you will be able to do it.

    If there was a possibility of USCIS handing a GC in person, you would have driven 50 hours. Can you not drive for 10hours for a cause that is affecting you, me and everyone around us?

    Now make up your mind and drive and meet other mid-westerners in DC.
