Called all 6 rep's offices plus my local north carolina 4th district rep David Price.
Everyone note down the bill numbers and said that they will pass on the message.. Mary Bono's office asked to call local rep office, which i did before..
Some of them were very nice and asked the address and name and all, whereas some of them just got the bill numbers and were eager to hang up the phone..
....Apart from contributing during the funding drive.. this is my first action to call reps...Felt great and encourage everyone else to give it a try....Try calling just one of them and you will feel the urge to call all of them and do your part...

I am not sure under what BILL they have a provision to remove US degree holders from actual Visa Numbers...but, we should also keep fighting for that because this would have two fold benefits:
1. All US degree holders will be benefited.
2. These US degree holder Numbers can be used by Non-US degree holders.
As everyone knows, most of the students will be unmarried when they enter the country for there degrees...and apply for GC after getting married....so, definitely if these numbers get eliminated from the actual visa numbers we would have double the numbers available for non-us degree holders...what do you guys think..????????

Question do we have to stop working upon receipt of the denial and wait until receipt of MTR? What are work options when a situation like this occurs
I have used ac21 and moved to a new employer and although my former employer have indicated that they will not revoke the approved I-140 (485 pending since Oct 07) if they do and USCIS does the same situation as described above for me & wife would I be out of status from that period?
Me being the primary applicant and wife the derivative are not using our H1's (I have 9 months remaining of my 6 year period and wife 3 years) I accepted a full time invoking Ac21 with the new company and joined using EAD. My wife has accepted a contract position using her EAD

As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.

Admin/Volunteers,
I think we should create a separate section/webpage and list all the members who have contributed 100$ or more. This might encourage others who have not contributed, to contribute. Also, this might encourage people who have contributed less than 100$ to contribute atleast 100$ and see their names in this special recognition section (not to mention the immense help they would do to the IV goal of 150K by may 1st).
Just a thought.

Read for free might not get us the results. Even now, the "guests" (a vast majority of total online population), cannot post.
Most "guests" are the ones would have never contributed or participated in any activities including funding.
We should make this site paid for just for the terrific value of info provided. If people start contributing, they will also be more inclined to participate in action items. Alternatively, anyone who attends or participates in meetings could be given "IV bucks.

This may not be related to this issues but I saw an update of 09/25/2007 on my H1 case with a previous employer whom I left in 2004. This case was approved in 2003.

Why
Silicon Valley is the world’s most advanced crucible of innovation, an example that countries all over the world have tried to emulate. The success of Silicon Valley as a global hub of innovation has a lot to do with it being the world’s foremost melting pot of highly skilled immigrants. In San Jose, the heart of Silicon Valley, these highly skilled, legal immigrants who want to continue that tradition of innovation by becoming permanent residents of this country will stage a peaceful protest rally to bring awareness and attention to their issues.
The people gathered at this peaceful walk are already huge contributors to the innovation edge of the US but their potential is still not fully tapped as it is still being hindered by unreasonable delays and bottlenecks in the process of gaining permanent residency (green-card).
With this effort, the skilled, legal immigrant community hopes to create awareness about their predicament and express their anguish and frustration at the reversal and the lack of action from the Government. These are the highly skilled workers who have been driving the innovation in the US for many decades and have been living in this country legally and yet, they feel that their issues, concerns and contributions to the economy have largely gone unnoticed. According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.
There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. With the San Jose rally, the community of skilled, legal immigrants wants to put focus on people who have abided by the law, played by the rules and ask for a fair treatment and attention to their issues.

Obama made a statement last night we should fix the Borken Legal Immigration System. I thought he knew about it. Thanks for the Ideas. I am going to ask a question about the yearly cap of 140K for EB Green cards
Clinton, Romney & McCain know about EB GC problems; they may not know some low level details. I don't know about Obama.
The questions are very very simple.
What do you plan to do about administrative delays (like labor, namecheck, ...)?
This can be done by the Prez alone!

There is no cRap on F1. There is no cRap on persons hired. Why should there be a cRap on GC?
I-485 approval should mean GC!
This needs congressional legislation!
If retrogression drags then H-1B rules (like pay stubs etc) should not be applicable!

I think some members have put their votes in wrong bucket.
Please check bucket BEFORE NOV 2002 and click on each member you will see some members from PD 2006 put their votes in this bucket.
Profile just displays Labor approval date, not application date. But interesting observation. Some have approval date of Nov 2002 -- so very possible that their PD is much earlier.

Thanks for the excellent info on pending applications. Now we can guess why EB3I is crawling for past few years.
With regular quota of 3000 per year EB3I (until July 2007) will be cleared in next 20+ years.

Guys, For better marketing our plight wearing business suits for rallys will have a significant impact on the perception of the rally on both onlookers and the press. It will immediately convey :
The professionalism of the crowd
The difference between previous illegal protestors and legal high skilled protesters
People will notice crowds of business suits and it will leave an imprint on their mind. Especailly in places like bay area they will just stick outOrganizers may want to think about this.
I guess formal or semi-formal wear should be good enough in the heat.

IMO standalone bills like these have little chance of passing. This is just a placeholder so that its text can be used in the CIR. Such bills are used to gauge the public reaction and the senates direction on the issue. The bill needs a companion bill from the house which will be difficult considering the composition of the house. In the coming months you will see many immigration related bills being introduced. We can always hope and write a letter to the senators about this bill, it has a better chance if there are more co sponsors.
As prof Wadhwa mentioned the best option for us is to write to the lawmakers outlining our issue, education is the key. i write to my senators and congressman every 3-4 months (no email). You will always get a reply to your letter, sometimes the reply is not relevant to the issue you have mentioned:rolleyes: but every bit helps...I hope each member writes a letter, numbers generally make an impact.

How do you know that all the unused visas go to EB3 before go to EB2?
Even if the immigration reform happens, will it take effect next year or sometime later? How come my PD can become current immediately once the immigration reform happens?

as soon as the president signs on the SKIL bill, it will become a law, and uscis will implement it within 24 hours. However, regarding your point about PD becoming current immediately: since many MS degree holders are in EB2, their PDs will become current immediately. So uscis will be able to move EB3 very fast. If it doesn't happen immediately, it will happen within a couple of months.
